Terms Used In Connecticut General Statutes > Chapter 18a - Joint Committee on Legislative Management

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • another: may extend and be applied to communities, companies, corporations, public or private, limited liability companies, societies and associations. See Connecticut General Statutes 1-1
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assist in the practice of physical therapy: means the treatment of any person by the employment of the effective properties of physical measures and the use of therapeutic exercises and rehabilitative procedures, with or without assistive devices, for the purpose of preventing, correcting or alleviating a physical or mental disability, but does not include the interpretation of referrals, initial or discharge evaluation or assessment, or determination or modification of treatment or discharge plans.   • Athletic injury: means any injury sustained as a result of participation in an exercise, a sport, a game, a recreational activity or any other activity that requires a level of strength, flexibility or agility that is comparable to the level of strength, flexibility or agility required for an exercise, a sport, a game or a recreational activity. See Connecticut General Statutes 20-65f
  • Athletic training: means (A) the application, with the consent and under the direction of a health care provider, of care for an athletic injury, including the application or provision of (i) principles, methods and procedures of clinical evaluation, prevention, management, emergency care, treatment, disposition and rehabilitation of athletic injuries, (ii) appropriate preventative and supportive devices, (iii) physical agents, including, but not limited to, heat, cold, light, electric stimulation, manual therapy techniques, aquatic therapy, sound and therapeutic exercise, and (iv) any other physical agent prescribed by a health care provider, (B) the recognition of potential illness and referrals to a health care provider for diagnosis and treatment, (C) the organization and administration of athletic training programs, (D) education and counseling to physically active individuals, coaches, medical personnel and the community in the area of the prevention and care of athletic injuries, and (E) the provision of wellness care services developed for physically active individuals who are free of any underlying pathologies that are beyond the scope of practice of a person who practices athletic training.   • Commissioner: means the Commissioner of Public Health. See Connecticut General Statutes 20-65f
  • Commissioner: means the Commissioner of Public Health, or the commissioner's designee. See Connecticut General Statutes 20-74a
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Department of Public Health. See Connecticut General Statutes 20-74a
  • Donor: The person who makes a gift.
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Health care provider: means any person licensed to practice medicine or surgery under chapter 370, chiropractic under chapter 372, podiatry under chapter 375, naturopathy under chapter 373 or nursing under §. See Connecticut General Statutes 20-65f
  • Illness: means any disease, disorder, sickness or affliction that arises from or is a manifestation of a physically active individual's participation in an exercise, a sport, a game, a recreational activity or other activity, or any other condition, that may require immediate intervention by an athletic trainer, acting with the consent and under the direction of a health care provider, during, prior to or following the physically active individual's participation in such exercise, a sport, a game, a recreational activity or other activity, including, but not limited to, the emergent and acute manifestations of exertion related illness, including an affliction of the physically active individual's cardiorespiratory, thermoregulation, musculoskeletal, neurovascular or endocrine system.   • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Jurisprudence: The study of law and the structure of the legal system.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • low-level light laser therapy: means low-level light therapy having wave lengths that range from six hundred to one thousand nanometers. See Connecticut General Statutes 20-66

  • month: means a calendar month, and the word "year" means a calendar year, unless otherwise expressed. See Connecticut General Statutes 1-1
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Occupational therapist: means a person licensed to practice occupational therapy as defined in this chapter and whose license is in good standing. See Connecticut General Statutes 20-74a
  • occupational therapy: includes , but is not limited to, evaluation and treatment of individuals whose abilities to cope with the tasks of living are threatened or impaired by developmental disabilities, the aging process, learning disabilities, poverty and cultural differences, physical injury or disease, psychological and social disabilities, or anticipated dysfunction, using (A) such treatment techniques as task-oriented activities to prevent or correct physical or emotional disabilities or to minimize the disabling effect of these disabilities in the life of the individual, (B) such evaluation techniques as assessment of sensory motor abilities, assessment of the development of self-care activities and capacity for independence, assessment of the physical capacity for prevocational and work tasks, assessment of play and leisure performance, and appraisal of living areas for persons with disabilities, (C) specific occupational therapy techniques such as activities of daily living skills, the fabrication and application of splinting devices, sensory motor activities, the use of specifically designed manual and creative activities, guidance in the selection and use of adaptive equipment, specific exercises to enhance functional performance and treatment techniques for physical capabilities for work activities.   • Occupational therapy assistant: means a person licensed to assist in the practice of occupational therapy, under the supervision of or with the consultation of a licensed occupational therapist, and whose license is in good standing. See Connecticut General Statutes 20-74a
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Personal property: All property that is not real property.
  • Physical therapist: means a person licensed to practice physical therapy in this state. See Connecticut General Statutes 20-66
  • Physical therapist assistant: means a person licensed to assist in the practice of physical therapy in this state under the supervision of a physical therapist. See Connecticut General Statutes 20-66
  • Physical therapy: includes the establishment and modification of physical therapy programs, treatment planning, instruction, wellness care, peer review, consultative services and the use of low-level light laser therapy for the purpose of accelerating tissue repair, decreasing edema or minimizing or eliminating pain, but does not include surgery, the prescribing of drugs, the development of a medical diagnosis of disease, injury or illness, the use of cauterization or the use of Roentgen rays or radium for diagnostic or therapeutic purposes.   • Physically active individual: means any person who is (A) (i) a member of any professional, amateur, school, collegiate or other sports organization, (ii) a regular participant in a sports activity, or (iii) a participant in an exercise, recreational or employment activity that requires strength, agility, flexibility, range of motion, speed or stamina that is comparable to the strength, agility, flexibility, range of motion, speed or stamina required of a regular participant in a sports activity, and (B) deemed healthy by a health care provider. See Connecticut General Statutes 20-65f
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Quorum: The number of legislators that must be present to do business.
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Standing orders: means written protocols, recommendations or guidelines for treatment and care of a physically active individual who is a member of a professional, amateur, school, collegiate or other sports organization, or of a physically active individual who requires treatment, first aid or care in an emergency situation, that (A) are furnished and signed by a health care provider, (B) are followed by an athletic trainer while performing athletic training with the consent and under the direction of a health care provider, (C) are annually reviewed and renewed by the health care provider and athletic trainer to ensure quality care of a physically active individual, (D) require the availability of ongoing communication between the health care provider and the athletic trainer, and (E) include (i) a plan for emergency situations, (ii) appropriate treatments for specific injuries or illnesses, (iii) instructions for the treatment and management of concussions, (iv) a list of conditions necessitating the immediate referral of a physically active individual to a health care provider under §. See Connecticut General Statutes 20-65f
  • Statute: A law passed by a legislature.
  • supervision: means the overseeing of or the participation in the work of a physical therapist assistant by a licensed physical therapist, including, but not limited to: (A) Continuous availability of direct communication between the physical therapist assistant and a licensed physical therapist. See Connecticut General Statutes 20-66
  • Supervision: means the overseeing of or participation in the work of an occupational therapy assistant by a licensed occupational therapist, including, but not limited to: (A) Continuous availability of direct communication between the occupational therapy assistant and the licensed occupational therapist. See Connecticut General Statutes 20-74a
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Venue: The geographical location in which a case is tried.
  • Wellness care: means care related to risk management and injury prevention, including biomechanics, conditioning, flexibility, nutrition, strength training and fitness. See Connecticut General Statutes 20-65f
  • Wellness care: means services related to conditioning, strength training, fitness, workplace ergonomics or injury prevention. See Connecticut General Statutes 20-66
  • With the consent and under the direction of a health care provider: means athletic training provided (A) under a written prescription issued by a health care provider that specifies the plan of care or treatment of a musculoskeletal injury or illness, or (B) with regard to a physically active individual's participation with a professional, amateur, school collegiate or other sports organization, under a standing order issued by a health care provider.
