§ 9614 Right to appeal

Terms Used In Delaware Code > Title 10 > Chapter 95 > Subchapter III - Trespass Actions

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department of Planning Services: means the Kent County Department of Planning Services. See Delaware Code Title 9 Sec. 5601
  • Kent County Levy Court: means the Levy Court for Kent County. See Delaware Code Title 9 Sec. 5601
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Property: means a lot, plot, or parcel of land, including any structures thereon. See Delaware Code Title 9 Sec. 5601
  • Structure: means a manmade object having an ascertainable stationary location on land or in water, whether or not affixed to the land. See Delaware Code Title 9 Sec. 5601
  • Summons: Another word for subpoena used by the criminal justice system.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
