Terms Used In Delaware Code > Title 25 > Chapter 49

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Board: shall mean the State Board of Veterinary Medicine established in this chapter. See Delaware Code Title 24 Sec. 3302
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Division: shall mean the state Division of Professional Regulation. See Delaware Code Title 24 Sec. 3302
  • dollars: means lawful money of the United States. See Delaware Code Title 6 Sec. 4307
  • Electronic mail: means communication delivered by electronic means as set forth in § 107(a)(1)a. See Delaware Code Title 24 Sec. 3305
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Last-known address: means that address provided by the occupant in the latest rental agreement or the address provided by the occupant in a subsequent written notice of a change of address. See Delaware Code Title 24 Sec. 3305
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Month: means a calendar month, unless otherwise expressed. See Delaware Code Title 6 Sec. 4307
  • Occupant: means a person, that person's sublessee, successor or assign, entitled to the use of the storage space at a self-service storage facility under a rental agreement, to the exclusion of others. See Delaware Code Title 24 Sec. 3305
  • Owner: means the owner, operator, lessor or sublessor of a self-service storage facility, his agent or any other person authorized by him or her to manage the facility or to receive rent from an occupant under a rental agreement. See Delaware Code Title 24 Sec. 3305
  • Personal property: means movable property not affixed to land and includes, but is not limited to, goods, merchandise and household items. See Delaware Code Title 24 Sec. 3305
  • Practice of veterinary medicine: shall mean :

  • Quorum: The number of legislators that must be present to do business.
  • real property: is synonymous with the phrase "lands, tenements and hereditaments. See Delaware Code Title 6 Sec. 4307
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rental agreement: means any agreement or lease, written or oral, that establishes or modifies the terms, conditions, rules or any other provisions concerning the use and occupancy of a self-service storage facility. See Delaware Code Title 24 Sec. 3305
  • Self-service storage facility: means any real property designed and used for the purpose of renting or leasing individual storage space to occupants who are to have access to such for the purpose of storing and removing personal property. See Delaware Code Title 24 Sec. 3305
  • State: shall mean the State of Delaware. See Delaware Code Title 24 Sec. 3302
  • Subpoena: A command to a witness to appear and give testimony.
  • Substantially related: means the nature of the criminal conduct, for which the person was convicted, has a direct bearing on the fitness or ability to perform 1 or more of the duties or responsibilities necessarily related to the practice of veterinary medicine. See Delaware Code Title 24 Sec. 3302
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Verified mail: means any method of mailing that is offered by the United States Postal Service or private delivery service that provides evidence of mailing. See Delaware Code Title 24 Sec. 3305
  • Veterinarian: shall mean a person who has received a degree in veterinary medicine from a school of veterinary medicine. See Delaware Code Title 24 Sec. 3302
  • Veterinary medicine: shall include veterinary surgery, obstetrics, dentistry and all other branches or specialties of veterinary medicine. See Delaware Code Title 24 Sec. 3302
  • Veterinary technician: shall mean a person who has received a degree from a veterinary technician program or its equivalent. See Delaware Code Title 24 Sec. 3302
  • Year: means a calendar year, and is equivalent to the words "year of our Lord. See Delaware Code Title 6 Sec. 4307
