(1) Definitions. As used in this rule;

  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
    (a) “”Citation”” means an instrument which is served upon a subject for the purpose of assessing a penalty in an amount established by this rule;
    (b) “”Subject”” means the licensee, applicant, person, partnership, corporation, or other entity alleged to have committed a violation designated in this rule.
    (2) In lieu of the disciplinary procedures contained in Florida Statutes § 548.071, the Department is hereby authorized to dispose of any violation designated herein by issuing a citation to the subject within six months after the filing of the complaint which is the basis for the citation.
    (3) Citations shall be issued for the first offense violations only unless otherwise specified.
    (4) The commission hereby designates possession of improper equipment or apparel, and/or failure to have the proper equipment or apparel as a citation violation for amateur sanctioning organizations, which shall result in a penalty of twenty-five dollars ($25.00).
    (5) The commission hereby designates the unlicensed practice of sanctioning or supervising an amateur match governed by Florida Statutes Chapter 548 as a citable violation that carries a penalty of a fine of $1,000, and costs of the investigation for first offense.
    (6) The commission hereby designates the unlicensed practice of sanctioning or supervising an amateur match governed by Florida Statutes Chapter 548 as a citable violation that carries a penalty of a fine of $2,500, and costs of the investigation for the second offense.
