Terms Used In 10 Guam Code Ann. § 10113

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
(a) When a minor, or an insane or incompetent person is a petitioner, he must appear either by general guardian or a Guardian Ad Litem appointed by the Superior Court of Guam. A Guardian Ad Litem may be appointed in a claim for arbitration under this chapter when it is deemed by a judge of the Superior Court of Guam expedient to represent the minor, insane, or incompetent person in the arbitration proceeding, notwithstanding he may have a general guardian and may have appeared by him. incompetent person in any arbitration proceeding shall have the power to compromise the same and to agree to any settlement or decision of the arbitrators to be entered therein against his ward, subject to the approval of a majority of the arbitrators.

(b) A Guardian Ad Litem appointed by the Superior Court of Guam to pursue a claim for arbitration shall be appointed pursuant to ‘373 of the
Guam Code of Civil Procedure. Any petition to appoint a Guardian Ad Litem to pursue a claim for arbitration shall have a copy of the demand for arbitration attached thereto.
