Terms Used In 12 Guam Code Ann. § 81114

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Statute: A law passed by a legislature.
is Chapter shall be liberally construed to effectuate its intent and purposes, without implied limitations. All rights and powers granted to the Authority in this Chapter shall be cumulative with those derived from other sources, and shall not, except as expressly stated in this Chapter, be construed in limitation thereof. Insofar as the provisions of this Chapter are inconsistent with the provisions of any other statute, the provisions of this Chapter are controlling. If any clause, sentence, paragraph, section or part of this Chapter is determined by any court of competent jurisdiction to be invalid, such determination shall not affect, impair or invalidate the remainder of this Chapter, but is confined in its operation to the clause, sentence, paragraph, section or part of the Chapter directly involved in the controversy in which such determination shall have been rendered.
