Terms Used In 15 Guam Code Ann. § 3111

  • Decedent: A deceased person.
  • Executor: A male person named in a will to carry out the decedent
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Probate: Proving a will
Allegations showing that this Article is applicable, together with a prayer that the estate be set aside as provided in this Article, may be presented without filing a petition for letters testamentary, letters of administration with the will annexed or letters of administration, by petition of the person named in the will as the executor or of the surviving spouse or of the guardian of the minor child or children of the decedent. Such allegations and prayer may also be included alternatively in the petition for letters testamentary, letters of administration with the will annexed or letter of administration, or such allegations and prayer may be presented by separate petition filed by the personal representative of the decedent, or by the surviving spouse, or by the guardian of the minor child or children, filed at any time before the hearing on the petition for letters testamentary, letters of administration with the will annexed or letters of administration or after the filing of the inventory. all cases the petition shall be verified. The allegations shall include a specific description and an estimate of the value of all of the decedent’s property, a list of all liens and encumbrances at the date of death, and a designation of any property as to which a homestead is set apart out of the decedent’s estate under the provisions of Section 2401 or Section
2409 of this Title.
