(a) An administrative penalty may be imposed upon a judgment by a court of competent jurisdiction or upon an order by the commissioner.

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
(b) The commissioner shall hold a hearing in accordance with chapter 91, prior to imposing any administrative remedy.
