Terms Used In Hawaii Revised Statutes 571-41.2

  • Detention: means the temporary care of children who require custody in physically secure facilities:

    (1) For their immediate welfare;

    (2) For the protection of the community;

    (3) While awaiting transfer to another jurisdiction; or

    (4) Because of violation of a family court order of probation or protective supervision. See Hawaii Revised Statutes 571-2

  • Judge: means judge of the family court. See Hawaii Revised Statutes 571-2

Any person who violates, or is alleged to have violated, any law of another state defining a crime and is at the time of the offense under the age of eighteen years, and who thereafter flees from that state and is found in this State may be proceeded against in the manner provided for in chapter 832. The circuit judge shall, for the purpose of detention, hold a hearing to determine whether the juvenile should be detained at the juvenile detention home or detention facility or in any other appropriate setting.
