1.  Upon a plea of not guilty.

Terms Used In Idaho Code 19-1901

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Conviction: A judgement of guilt against a criminal defendant.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
2.  Upon a plea of a former conviction or acquittal of the same offense.
3.  Upon a plea of once in jeopardy.
