Terms Used In Idaho Code > Title 18 > Chapter 61 - Rape

  • ABGC: means the American board of genetic counseling, inc. See Idaho Code 54-5602
  • ABMG: means the American board of medical genetics, its successor or equivalent. See Idaho Code 54-5602
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • ACS: means active candidate status conferred by the American board of genetic counseling. See Idaho Code 54-5602
  • Apprentice: means a person registered with the barber and cosmetology services licensing board to learn an occupation in a licensed establishment who, while so learning, performs or assists in performing any practices of barbering, barber-styling, cosmetology, or electrology. See Idaho Code 54-5802
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Barber: means a person licensed to practice barbering as defined in this section. See Idaho Code 54-5802
  • Barber-styling: means any one (1) or any combination of the following practices when performed on the upper part of the human body for cosmetic purposes and not for the treatment of disease or physical or mental ailments:

  • Barber-stylist: means a person licensed to practice barber-styling as defined in this section. See Idaho Code 54-5802
  • Barbering: means any one (1) or any combination of the following practices when performed on the upper part of the human body for cosmetic purposes and not for the treatment of disease or physical or mental ailments:

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the Idaho driving businesses licensure board, which will act as the state regulatory body for driving businesses hereinafter provided in this chapter. See Idaho Code 54-5402
  • Board: means the Idaho state board of midwifery. See Idaho Code 54-5502
  • Board: means the genetic counselors licensing board. See Idaho Code 54-5602
  • Board: means the barber and cosmetology services licensing board established by section 54-5806, Idaho Code. See Idaho Code 54-5802
  • Board: means the state board of pharmacy created in chapter 17, title 54, Idaho Code, or its successor agency. See Idaho Code 37-2701
  • Board: means the Idaho board of naturopathic health care. See Idaho Code 54-5902
  • Certification: means the voluntary process by which a nongovernmental agency grants recognition and use of a credential to individuals who have met predetermined and standardized criteria. See Idaho Code 54-5602
  • Client: means a woman under the care of a licensed midwife, as well as her fetus and newborn child. See Idaho Code 54-5502
  • Code of ethics: means the current code of ethics adopted by the board. See Idaho Code 54-5602
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Controlled substance: means a drug, substance or immediate precursor in schedules I through VI of article II of this chapter. See Idaho Code 37-2701
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cosmetologist: means a person licensed to practice cosmetology as defined in this section. See Idaho Code 54-5802
  • Cosmetology: means any one (1) or any combination of the following practices when performed on the human body for cosmetic purposes and not for the treatment of disease or physical or mental ailments:

  • CPM: means a person who is certified by the North American registry of midwives or any successor organization. See Idaho Code 54-5502
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • delivery: means the actual, constructive, or attempted transfer from one person to another of a controlled substance, whether or not there is an agency relationship. See Idaho Code 37-2701
  • Division: means the division of occupational and professional licenses. See Idaho Code 54-5502

  • Driver education: means classroom instruction and behind-the-wheel driving time. See Idaho Code 54-5402
  • Driving business: means any driver education business established for the education of students in a classroom or motor vehicle, or both, which education shall not qualify a student for a commercial driver’s license. See Idaho Code 54-5402
  • Driving instructor: means a person who is licensed by the board to teach the classroom instruction phase and behind-the-wheel training phase of automobile driver training. See Idaho Code 54-5402
  • Drug: means : (1) substances recognized as drugs in the official United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States, or official National Formulary, or any supplement to any of them; (2) substances intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease in man or animals; (3) substances, other than food, intended to affect the structure or any function of the body of man or animals; and (4) substances intended for use as a component of any article specified in clause (1), (2), or (3) of this subsection. See Idaho Code 37-2701
  • Electrologist: means a person licensed to practice electrology, as defined in this section, and skilled in the permanent removal of unwanted hair. See Idaho Code 54-5802
  • Establishment: means a place licensed under this chapter, other than a licensed school, where barbering, barber-styling, cosmetology or electrology is practiced. See Idaho Code 54-5802
  • Esthetician: means a person licensed to practice esthetics as defined in this section. See Idaho Code 54-5802
  • Esthetics: means noninvasive care of the skin by application of cosmetic preparations, antiseptics, tonics, lotions, creams and essential oils to cleanse, massage, exfoliate, hydrate and stimulate; makeup application; pore extraction; use of chemical exfoliants approved for professional esthetic use; particle exfoliation; use of any class I medical device, as classified by the United States food and drug administration, designed for care of the skin, except that a class II medical device designed for care of the skin may be used as directed and supervised by an authorized and licensed health care practitioner; temporary removal of superfluous hair by lotions, creams, waxing, tweezing, depilatories or other means; and tinting or perming the eyebrows and eyelashes.   • Estimated due date: means the estimated date of delivery with a known date of conception, known date of last menstrual period or first trimester ultrasound. See Idaho Code 54-5502
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fraud: Intentional deception resulting in injury to another.
  • Genetic counseling: means performing acts of a genetic counselor as described in section 54-5603, Idaho Code. See Idaho Code 54-5602
  • Genetic counselor: means an individual who is licensed under this chapter to engage in the practice of genetic counseling. See Idaho Code 54-5602
  • Haircutting: means cutting, trimming, arranging, dressing, curling, cleansing, singeing or performing similar work on the hair and fitting, cutting or dressing hairpieces or toupees. See Idaho Code 54-5802
  • Health care services: means :

  • High school student: means a person who has completed the first two (2) years of high school and is enrolled in a high school or secondary school licensed under this chapter. See Idaho Code 54-5802
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Instructor: means a person licensed under this chapter to practice and teach any practice defined in this section. See Idaho Code 54-5802
  • Instructor trainee: means a barber, barber-stylist or cosmetologist attending a licensed school to receive training to teach barbering, barber-styling or cosmetology. See Idaho Code 54-5802
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • License: means a document issued by the division of occupational and professional licenses on behalf of the board officially documenting the individual’s right to practice as a driving instructor or to operate a driving business within the state of Idaho. See Idaho Code 54-5402
  • License: means a license to practice as a licensed naturopathic doctor. See Idaho Code 54-5902
  • Licensed health care provider: means a physician or physician assistant or an advanced practice registered nurse. See Idaho Code 54-5502
  • Licensed midwife: means a person who holds a current license issued by the board pursuant to the provisions of this chapter to engage in the practice of midwifery, who shall be designated "L. See Idaho Code 54-5502
  • Licensed naturopathic doctor: means an individual licensed as a medical doctor, doctor of osteopathy, doctor of podiatric medicine, doctor of chiropractic, doctor of dental medicine, or doctor of nursing practice who has obtained an approved naturopathic doctoral degree, as set forth in rule, and who voluntarily elects to seek and receives licensure under this chapter to practice naturopathic health care in Idaho. See Idaho Code 54-5902
  • Licensed physician: means a person holding a license issued under chapter 18, title 54, Idaho Code. See Idaho Code 54-5602
  • Licensed school: means a secondary or postsecondary barber, cosmetology, or electrology school that:
  • Idaho Code 54-5802
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Makeover or glamour photography business: means a business offering photographic services to the general public in which the business’s employees apply cosmetic products to customers’ faces or arrange the hair of customers in connection with the sale or attempted sale of photographic services. See Idaho Code 54-5802
  • Makeup artist: means a person certificated to practice makeup artistry as defined in this section. See Idaho Code 54-5802
  • Makeup artistry: means noninvasive care of the skin by application of cosmetic preparations for cleansing and the application of makeup, which includes the application of cosmetics or any pigment product that is used to cover, camouflage or decorate the skin. See Idaho Code 54-5802
  • Manufacture: means the production, preparation, propagation, compounding, conversion or processing of a controlled substance, and includes extraction, directly or indirectly, from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of the substance or labeling or relabeling of its container, except that this term does not include the preparation or compounding of a controlled substance:

  • MEAC: means the organization established in 1991 and recognized by the U. See Idaho Code 54-5502
  • Month: means a calendar month, unless otherwise expressed. See Idaho Code 73-114
  • NACPM: means the national organization for certified professional midwives. See Idaho Code 54-5502
  • Nail technician: means a person licensed to practice nail technology as defined in this section. See Idaho Code 54-5802
  • Nail technology: means any one (1) or more of the following practices when performed on the human body:

  • Naturopathic health care: means the delivery of a distinct primary health care emphasizing prevention, treatment, and optimal health using therapeutic methods and substances that encourage an individual’s inherent self-healing process by a naturopathic practitioner. See Idaho Code 54-5902
  • NSGC: means the national society of genetic counselors, its successor or equivalent. See Idaho Code 54-5602
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • person: includes a corporation as well as a natural person;

  • Person: means an individual and does not mean an association of individuals or a legal entity. See Idaho Code 54-5602
  • Person: means individual, corporation, government, or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Idaho Code 37-2701
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Practice of midwifery: means providing maternity care for women and their newborns during the antepartum, intrapartum and postpartum periods. See Idaho Code 54-5502
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Property: includes both real and personal property. See Idaho Code 73-114
  • Provider: means any health care provider who is licensed or required to be licensed under this title or, if located outside of Idaho, would be required to be licensed under this title for the purposes of diagnosing or treating physical or behavioral health conditions. See Idaho Code 54-5703
  • Provider group: means any group of licensed providers who have access to shared patient medical records and are organized to provide team-based or multidisciplinary care to patients. See Idaho Code 54-5703
  • Quorum: The number of legislators that must be present to do business.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retail cosmetics dealer: means a stationary business offering cosmetic products for sale at retail to the general public in which the business’s employees apply cosmetic products to customers’ faces in connection with the sale or attempted sale of the products without compensation from the customer other than the regular price of the products. See Idaho Code 54-5802
  • Retail thermal styling equipment dealer: means a retail business that offers thermal styling equipment, such as curling irons, curling wands, flat irons, heated hair rollers, blow-dryers or other devices using heat to style hair, for sale at retail to members of the general public and whose employees engage in the limited use of thermal styling equipment on customers in connection with the sale or attempted sale of the equipment without compensation from the customer other than the regular price of the equipment. See Idaho Code 54-5802
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
  • State: when applied to a part of the United States, includes any state, district, commonwealth, territory, insular possession thereof, and any area subject to the legal authority of the United States of America. See Idaho Code 37-2701
  • Static online questionnaire: means a questionnaire provided to a patient to which the patient responds with a static set of answers. See Idaho Code 54-5703
  • Statute: A law passed by a legislature.
  • Student: means a person learning barbering, barber-styling, cosmetology or electrology at a licensed school who, while so learning, performs or assists in performing any practices of barbering, barber-styling, cosmetology or electrology. See Idaho Code 54-5802
  • Subpoena: A command to a witness to appear and give testimony.
  • Testify: Answer questions in court.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Virtual care: means technology-enabled health care services in which the patient and provider are not in the same location. See Idaho Code 54-5703
