Terms Used In Idaho Code > Title 18

  • access: means to instruct, communicate with, store data in, retrieve data from or otherwise make use of any resources of a computer, computer system, or computer network. See Idaho Code 18-2201
  • Acquired entity: is a s defined in section 30-22-102(a)(1), Idaho Code. See Idaho Code 30-29-1101
  • Acquiring entity: is a s defined in section 30-22-102(a)(2), Idaho Code. See Idaho Code 30-29-1101
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administer: means the direct application of a controlled substance whether by injection, inhalation, ingestion, or any other means, to the body of a patient or research subject by:

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Agent: means an authorized person who acts on behalf of or at the direction of a manufacturer, distributor or dispenser. See Idaho Code 37-2701
  • Aggravated offense: means any of the following crimes: 18-1506A (ritualized abuse of a child); 18-1508 (lewd conduct); 18-4003(d) (murder committed in the perpetration of rape); 18-4502 (first-degree kidnapping committed for the purpose of rape, committing an infamous crime against nature, committing any lewd and lascivious act upon any child under the age of sixteen years or for purposes of sexual gratification or arousal); 18-4503 (second-degree kidnapping where the victim is an unrelated minor child and the kidnapping is committed for the purpose of rape, committing an infamous crime against nature, committing any lewd and lascivious act upon any child under the age of sixteen years or for purposes of sexual gratification or arousal); 18-6101 (rape, but excluding section 18-6101(1) where the victim is at least twelve years of age or the defendant is eighteen years of age); 18-6608 (forcible penetration by use of a foreign object); 18-8602(1)(a)(i) (sex trafficking); and any other offense set forth in section 18-8304, Idaho Code, if at the time of the commission of the offense the victim was below the age of thirteen (13) years or an offense that is substantially similar to any of the foregoing offenses under the laws of another jurisdiction or military court or the court of another country.   • Aggrieved person: means a person who was a party to any illegally intercepted wire, electronic or oral communication or a person against whom the interception was illegally directed. See Idaho Code 18-6701
  • Allegation: something that someone says happened.
  • Amortization: Paying off a loan by regular installments.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Audiovisual recording function: means the capability of a device to record or transmit a motion picture or any part thereof by means of any technology now known or later developed. See Idaho Code 18-6902
  • Aural transfer: means a transfer containing the human voice at any point between and including the point of origin and the point of reception. See Idaho Code 18-6701
  • Authorized credit card merchant: means a person or organization who is authorized by an issuer to furnish money, goods, services or anything of value upon presentation of a financial transaction card or a financial transaction card account number by a card holder, and to present valid credit card sales drafts to the issuer for payment. See Idaho Code 18-3122
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bequest: Property gifted by will.
  • Board: means the state board of pharmacy created in chapter 17, title 54, Idaho Code, or its successor agency. See Idaho Code 37-2701
  • Board: means the sexual offender management board described in section 18-8312, Idaho Code. See Idaho Code 18-8303
  • Bureau: means the drug enforcement administration, United States department of justice, or its successor agency. See Idaho Code 37-2701
  • Card holder: means any person or organization named on the face of a financial transaction card to whom, or for whose benefit, a financial transaction card is issued by an issuer. See Idaho Code 18-3122
  • Central registry: means the registry of convicted sexual offenders maintained by the Idaho state police pursuant to this chapter. See Idaho Code 18-8303
  • Certified evaluator: means either a psychiatrist licensed by this state pursuant to chapter 18, title 54, Idaho Code, or a master’s or doctoral level mental health professional licensed by this state pursuant to chapter 23, chapter 32, or chapter 34, title 54, Idaho Code. See Idaho Code 18-8303
  • Chambers: A judge's office.
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Circumstantial evidence: All evidence except eyewitness testimony.
  • Civil disorder: means any public disturbance involving acts of violence by an assemblage of two (2) or more persons which acts cause an immediate danger of or result in damage or injury to the property or person of any other individual. See Idaho Code 18-8102
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
  • Computer: means , but is not limited to, an electronic device which performs logical, arithmetic, or memory functions by the manipulations of electronic or magnetic impulses, and includes all input, output, processing, storage, software, or communication facilities which are connected or related to such a device in a system or network. See Idaho Code 18-2201
  • Computer network: means , but is not limited to, the interconnection of communication lines (including microwave or other means of electronic communication) with a computer through remote terminals, or a complex consisting of two (2) or more interconnected computers. See Idaho Code 18-2201
  • Computer software: means , but is not limited to, computer programs, procedures, and associated documentation concerned with the operation of a computer system. See Idaho Code 18-2201
  • Computer system: means , but is not limited to, a set of related, connected or unconnected, computer equipment, devices, and software. See Idaho Code 18-2201
  • Concealed weapon: means any deadly weapon carried on or about the person in a manner not discernible by ordinary observation;
  • Idaho Code 18-3302
  • Contents: when used with respect to any wire, electronic or oral communication includes any information concerning the identity of the parties to such communication or the existence, substance, purport, or meaning of that communication. See Idaho Code 18-6701
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Controlled substance: means a drug, substance or immediate precursor in schedules I through VI of article II of this chapter. See Idaho Code 37-2701
  • Conversion: is a s defined in section 30-22-102(a)(4), Idaho Code. See Idaho Code 30-29-901
  • Converted entity: is a s defined in section 30-22-102(a)(5), Idaho Code. See Idaho Code 30-29-901
  • Converting entity: is a s defined in section 30-22-102(a)(6), Idaho Code. See Idaho Code 30-29-901
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Counterfeit substance: means a controlled substance which, or the container or labeling of which, without authorization, bears the trademark, trade name, or other identifying mark, imprint, number or device, or any likeness thereof, of a manufacturer, distributor or dispenser other than the person who in fact manufactured, distributed or dispensed the substance. See Idaho Code 37-2701
  • Court: means district courts of this state, including the magistrates division, and includes, when the context requires, any judge of the court;
  • (2)  "Clerk" and "clerk of the court" mean the duly elected and acting clerk of the district court and ex officio auditor and recorder and duly appointed deputies;
