(a) This Act applies to:
         (1) a fiduciary acting under a will or power of
    
attorney executed before, on, or after the effective date of this Act;
        (2) a personal representative acting for a decedent
    
who died before, on, or after the effective date of this Act;
        (3) a guardianship proceeding commenced before, on,
    
or after the effective date of this Act; and
        (4) a trustee acting under a trust created before,
    
on, or after the effective date of this Act.
    (b) This Act applies to a custodian if the user resides in this state or resided in this state at the time of the user’s death.

Terms Used In Illinois Compiled Statutes 755 ILCS 70/3

  • Fiduciary: A trustee, executor, or administrator.
  • State: when applied to different parts of the United States, may be construed to include the District of Columbia and the several territories, and the words "United States" may be construed to include the said district and territories. See Illinois Compiled Statutes 5 ILCS 70/1.14
  • Trustee: A person or institution holding and administering property in trust.

     (c) This Act does not apply to a digital asset of an employer used by an employee in the ordinary course of the employer’s business.
