Sec. 5. “Hospice program patient” means a patient who:
(1) has been diagnosed by a licensed physician as having a terminal illness;
(2) has a prognosis for a life expectancy in accordance with 42 C.F.R. § 418.3; and
(3) receives hospice services from a hospice program.
