Indiana Code 27-7-9-9.5. Assistance with adjusting of claims; responsibility of insurer; costs paid from fund

Sec. 9.5. (a) The commissioner shall provide insurers with assistance from one (1) or more individuals with technical expertise in mine subsidence for the purpose of assisting with the adjusting of claims under coverage issued under this chapter. If the commissioner considers it necessary in order to comply with this section, the commissioner may:
(2) enter into contracts providing for the services of persons with the necessary technical expertise to provide assistance to insurers in the determination of subsidence events.

- commissioner: refers to the insurance commissioner. See Indiana Code 27-7-9-1
- insurer: has the meaning set forth in IC 27-1-2-3(x). See Indiana Code 27-7-9-2
- mine subsidence: means the collapse of an underground coal mine resulting in damage to a structure. See Indiana Code 27-7-9-3
(b) The adjustment of a claim against a policy that includes mine subsidence coverage under this chapter is the sole responsibility of the insurer until the insurer makes a preliminary determination that the loss may involve mine subsidence. Upon such a determination, those persons retained by the commissioner as set out in subsection (a) shall assist the commissioner and insurer in determining the existence of a mine subsidence event and the costs of the event shall be paid from the fund established by section 7 of this chapter.
