Sec. 3. (a) As used in this chapter, “plan sponsor” means a person that establishes, adopts, or maintains a health benefit plan that covers individuals in Indiana.

     (b) The term includes a health benefit plan established, adopted, or maintained:

  • health benefit plan: means a policy, contract, certificate, or agreement that is entered into, offered by, or issued by an insurer to provide, deliver, arrange for, pay for, or reimburse any of the costs of health care services. See Indiana Code 27-8-4.9-2
(1) by an employer;

(2) jointly by an employer and one (1) or more employee organizations; or

(3) by an association, committee, joint board of trustees, or any similar group of representatives.

     (c) The term does not include an entity regulated under this title.
