Sec. 34. (a) In determining the amount of the award, the division shall determine whether the victim contributed to the infliction of the victim’s injury or death.
(c) If the division further finds that the victim’s contributory conduct was solely attributable to an effort to:

Terms Used In Indiana Code 5-2-6.1-34
- division: refers to the victim services division of the Indiana criminal justice institute. See Indiana Code 5-2-6.1-2
- person: includes a sole proprietorship, a partnership, a corporation, an association, a fiduciary, and an individual. See Indiana Code 5-2-6.1-6
- victim: means an individual who suffers bodily injury or death as a result of a violent crime. See Indiana Code 5-2-6.1-7
(1) prevent a crime from occurring; or
(2) apprehend a person who committed a crime;
in the victim’s presence, the victim’s contributory conduct does not render the victim ineligible for compensation.
