Terms Used In Indiana Code 8-23-7-12

  • Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
   Sec. 12. If condemnation proceedings have been instituted concerning real property, the department shall certify to the state comptroller that the voucher submitted is for escrow and is to be paid to the clerk of the circuit court. The voucher shall be in the amount determined and filed with the clerk of the circuit court. The payment shall be for the use and benefit of the owner of the property sought to be purchased.
