Terms Used In Indiana Code > Title 10 > Article 17 - Veterans' Affairs

  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • armed forces: includes the active or reserve components of the following:

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • cemetery: refers to the Indiana state veterans' cemetery established by this chapter. See Indiana Code 10-17-11-1
  • commission: refers to the Indiana veterans' affairs commission established by IC 10-17-13-4. See Indiana Code 10-17-1-1.5
  • commission: refers to the Indiana veterans' affairs commission established by IC 10-17-13-4. See Indiana Code 10-17-11-2
  • commission: refers to the Indiana veterans' affairs commission established by IC 10-17-13-4. See Indiana Code 10-17-12-3.5
  • commission: refers to the Indiana veterans' affairs commission established by section 4 of this chapter. See Indiana Code 10-17-13-1.5
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • coordinator: refers to the Hoosier women veterans coordinator designated under section 7 of this chapter. See Indiana Code 10-17-14-1
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • court martial: has the meaning set forth in IC 10-16-1-8. See Indiana Code 10-17-12-3.7
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Decedent: A deceased person.
  • department: refers to the Indiana department of veterans' affairs established by IC 10-17-1-2. See Indiana Code 10-17-11-3
  • department: refers to the Indiana department of veterans' affairs established by IC 10-17-1-2. See Indiana Code 10-17-12-4

  • Dependent: A person dependent for support upon another.

  • director: refers to the director of veterans' affairs appointed under IC 10-17-1-5. See Indiana Code 10-17-9-0.3

  • Donor: The person who makes a gift.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • fund: refers to the military family relief fund established by section 8 of this chapter. See Indiana Code 10-17-12-6
  • fund: refers to the veterans' affairs trust fund established by section 3 of this chapter. See Indiana Code 10-17-13-2
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • home: refers to the Indiana Veterans' Home. See Indiana Code 10-17-9-0.5
  • honorably discharged veterans: includes persons placed on inactive duty under honorable conditions but not discharged from military service. See Indiana Code 10-17-3-1
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • medical record: means written or printed information possessed by a provider (as defined in Ind. See Indiana Code 1-1-4-5
  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • Minority leader: See Floor Leaders
  • Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
  • national guard: means :

  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • prisoner of war or person missing in action: means a person who:

  • private employer: means a sole proprietor, corporation, partnership, limited liability company, or other entity with one (1) or more employees. See Indiana Code 10-17-15-2
  • Probate: Proving a will
  • program: refers to the Hoosier women veterans program established by section 6 of this chapter. See Indiana Code 10-17-14-4
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • qualified entity: means an entity that provides services to veterans and is exempt from taxation under Section 501 of the Internal Revenue Code. See Indiana Code 10-17-13.5-2
  • qualified service member: means , before the commission's issuance of the disallowable separation codes list for each branch of the armed forces described in section 10. See Indiana Code 10-17-12-7.5
  • Quorum: The number of legislators that must be present to do business.
  • real property: include lands, tenements, and hereditaments. See Indiana Code 1-1-4-5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Statute: A law passed by a legislature.
  • superintendent: refers to the superintendent of the Indiana Veterans' Home appointed under section 3. See Indiana Code 10-17-9-0.8
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
  • veteran: includes "Hoosier veteran" and applies to the construction of all Indiana statutes, unless the construction is expressly excluded by the terms of the statute, is plainly repugnant to the intent of the general assembly or of the context of the statute, or is inconsistent with federal law.   • veteran: means an individual residing in Indiana who:
