Terms Used In Indiana Code > Title 12 > Article 10 - Aging Services

  • activities of daily living: refers to an activity described in the long term care services eligibility screen. See Indiana Code 12-10-10-1.5
  • administrator: means a natural person who administers, manages, supervises, or is in general administrative charge of a housing with services establishment. See Indiana Code 12-10-15-1.5
  • adult protective services unit: refers to the entity with whom the division contracts to carry out the duties listed in section 8 of this chapter. See Indiana Code 12-10-3-1
  • Allegation: something that someone says happened.
  • ancillary services: means services ancillary to the basic services provided to an individual in need of self-directed in-home care who needs at least one (1) of the basic services (as defined in section 4 of this chapter). See Indiana Code 12-10-17.1-2
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • area agency: means an area agency on aging designated by the bureau under IC 12-10-1-4. See Indiana Code 12-10-5.7-1
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • assisted living services: refers to services covered under a waiver and provided in any of the following entities:

  • attendant care services: means those basic and ancillary services that the individual chooses to direct and supervise a personal services attendant to perform and that enable an individual in need of self-directed in-home care to live in the individual's home and community rather than in an institution and to carry out functions of daily living, self-care, and mobility. See Indiana Code 12-10-17.1-3
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • basic services: means a function that could be performed by the individual in need of self-directed in-home care if the individual did not have a physical disability. See Indiana Code 12-10-17.1-4
  • bill payer: means a person appointed by the secretary or the secretary's designee under this chapter to provide one (1) or more of the following services in order to assist a low income individual who is able to make responsible decisions about financial matters but needs assistance:

  • case management: means a service conducted locally by an area agency on aging that includes the following:

  • commission: refers to the Indiana state commission on aging established by this chapter. See Indiana Code 12-10-2-1
  • community and home care services: means services provided within the limits of available funding to an eligible individual. See Indiana Code 12-10-10-2
  • Dependent: A person dependent for support upon another.
  • eligible individual: means an individual who meets the following criteria:

  • endangered adult: means an individual who is:

  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • governmental entity: means an office or a department that is under the direct supervision of a local elected official or a county office. See Indiana Code 12-10-3-3
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • health facility: means a facility that is licensed under or subject to IC 16-28. See Indiana Code 12-10-5.5-2
  • health related services: means home health services as listed under IC 16-27-1-5(b) and IC 16-27-1-5(c), attendant and personal care services, professional nursing services, and the central storage and distribution of medications. See Indiana Code 12-10-15-2
  • health related services: means those medical activities that, in the written opinion of the attending physician submitted to the case manager of the individual in need of self-directed in-home care, could be performed by the individual if the individual were physically capable, and if the medical activities can be safely performed in the home, and:

  • housing with services establishment: has the meaning set forth in IC 12-10-15-3. See Indiana Code 12-10-5.5-2.5
  • housing with services establishment: means an establishment providing sleeping accommodations to at least five (5) residents and offering or providing for a fee:

  • incapacitated individual: means an individual who:

  • individual in need of self-directed in-home care: means an individual with a disability, or person responsible for making health related decisions for the individual with a disability, who:

  • individual with a disability: refers to an individual with a severe chronic disability that is attributable to a mental or physical impairment or combination of mental and physical impairments that is likely to continue indefinitely. See Indiana Code 12-10-10-3
  • institution: means any of the following:

  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • legal assistance developer: has the meaning set forth in 42 U. See Indiana Code 12-10-13-3.2
  • legal representative: means :

  • level of services: means a determination of the type of services an individual may receive under a Medicaid waiver based on the individual's impairment and dependence and the corresponding reimbursement rate for the determined level of care. See Indiana Code 12-10-11.5-8
  • licensed health professional: means any of the following:

  • life threatening emergency: means a situation in which:

  • long term care facility: means any of the following:

  • long term care services eligibility screen: refers to the long term care services eligibility screen used by the division in making eligibility determinations under this chapter. See Indiana Code 12-10-10-4.5
  • Minority leader: See Floor Leaders
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • office: includes the following:

  • office: refers to the long term care ombudsman office established by this chapter. See Indiana Code 12-10-13-4
  • ombudsman: means an individual or entity designated by the state ombudsman to investigate and resolve local complaints and concerns regarding the health, safety, welfare, or rights of residents. See Indiana Code 12-10-13-4.5
  • operator: means a person that operates a housing with services establishment. See Indiana Code 12-10-15-4
  • personal services attendant: means an individual who is registered to provide attendant care services under this chapter and who has entered into a contract with an individual and acts under the individual's direction to provide attendant care services that could be performed by the individual if the individual were physically capable. See Indiana Code 12-10-17.1-8
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • program: means a dementia care specialist program established by an area agency under this chapter. See Indiana Code 12-10-5.7-2
  • program: refers to the community and home options to institutional care for the elderly and disabled program established by this chapter. See Indiana Code 12-10-10-5
  • protective services: refers to available medical, psychiatric, residential, and social services that are necessary to protect the health or safety of an endangered adult. See Indiana Code 12-10-3-5
  • provider: refers to a regional guardianship services provider. See Indiana Code 12-10-7-3
  • region: means a service provision region established by the division by rule adopted under IC 4-22-2. See Indiana Code 12-10-7-4
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • representative payee: means a person appointed by the United States Social Security Administration, the United States Office of Personnel Management, the United States Department of Veterans Affairs, or the United States Railroad Retirement Board to provide one (1) or more of the following financial management services in order to assist an individual who is receiving government benefits and is medically incapable of making responsible financial decisions:

  • resident: means an individual who has a contract to reside in a housing with services establishment. See Indiana Code 12-10-15-5
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • specialist: means a dementia care specialist designated by an area agency to administer a program under section 4 of this chapter. See Indiana Code 12-10-5.7-3
  • state ombudsman: refers to the individual appointed by the secretary or the secretary's designee to run the state long term care ombudsman program and office under 42 U. See Indiana Code 12-10-13-6
  • Statute: A law passed by a legislature.
  • supportive services: means help with personal laundry, handling or assisting with personal funds of the residents, or arranging for medical services, health related services, or social services. See Indiana Code 12-10-15-6
