  • action level for lead: means the concentration of lead in water of fifteen (15) parts per billion, or fifteen-thousandths (0. See Indiana Code 16-41-21.2-1
  • activity based therapy services: refers to specialized interventions that activate the neuromuscular system below the level of the lesion, involving intense, repetitive physical activity performed with the goal of retraining the nervous system to recover specific motor tasks. See Indiana Code 16-41-42.2-0.5
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • agricultural labor camp: includes at least one (1) building or structure, tent, trailer, or vehicle, including the land, established, operated, or used as living quarters for at least five (5) adult seasonal or temporary workers engaged in agricultural activities, including related food processing. See Indiana Code 16-41-26-1
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • approved laboratory: means a laboratory approved by the state department for making serological tests. See Indiana Code 16-41-15-1
  • artificial insemination: means the introduction of semen into the vagina or cervix of a woman by means other than through the act of coitus. See Indiana Code 16-41-14-2
  • assembly: means a collection of individuals gathered together at any location at any one (1) time for any purpose. See Indiana Code 16-41-22-2
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • autologous donation: means the removal and storage of blood from a donor or patient for an intended transfusion to the same donor or patient. See Indiana Code 16-41-12-1
  • bank: has the meaning set forth in Indiana Code 16-41-12-2
  • bed and breakfast establishment: means an operator occupied residence that meets the following conditions:

  • bedding: means any mattress, mattress pad, mattress protector pad, box spring, upholstered spring, upholstered sofa bed, quilted pad, comforter, bolster, cushion, pillow, featherbed, sleeping bag, or any other bag, case, or covering that meets the following conditions:

  • biologicals: means drugs and vaccines. See Indiana Code 16-41-19-1
  • blood: means any of the following:

  • blood center: includes a blood bank, a blood storage facility, a plasma center, a hospital, or other facility where blood is collected. See Indiana Code 16-41-12-3
  • board: refers to the spinal cord and brain injury research board established by section 5 of this chapter. See Indiana Code 16-41-42.2-1
  • broadband Internet: means a connection to the Internet that provides an actual speed of at least fifty (50) megabits per second downstream and at least five (5) megabits per second upstream, regardless of the technology or medium used to provide the connection. See Indiana Code 4-4-41-1
  • child care facility: means any of the following:

  • childhood hazards: means the following preventable causes of death to children:

  • Clerk: means the clerk of the court or a person authorized to perform the clerk's duties. See Indiana Code 1-1-4-5
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • confirmatory test: means a laboratory test or a series of tests approved by the state department and used in conjunction with a screening test to confirm or refute the results of the screening test for the human immunodeficiency virus (HIV) antigen or antibodies to the human immunodeficiency virus (HIV). See Indiana Code 16-41-12-4
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dependent: A person dependent for support upon another.
  • design daily flow: means the calculated peak daily sewage flow from a residence. See Indiana Code 16-41-25-0.4
  • Devise: To gift property by will.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • distributed for use: refers to a blood center releasing or shipping blood for use in a blood inventory intended for or made available for transfusion or injection to a patient. See Indiana Code 16-41-12-5.5
  • Documentary material: means the original or a copy of a book, record, report, memorandum, paper, communication, tabulation, chart, or other document. See Indiana Code 4-6-3-1
  • Donor: The person who makes a gift.
  • donor insemination: means artificial insemination by a donor. See Indiana Code 16-41-14-3
  • effective treatment: means treatment that meets the following conditions:

  • eligible township: means :

  • emergency medical services provider: means a firefighter, a law enforcement officer, a paramedic, an emergency medical technician, a physician licensed under Indiana Code 16-41-10-1
  • employer: has the meaning set forth in Indiana Code 16-41-11-1
  • entity: means any business, association, or governmental entity. See Indiana Code 16-41-43-2
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • facility: means a building where an individual handles blood or other body fluids in the regular course of the individual's employment. See Indiana Code 16-41-11-2
  • filling material: means the following:

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • fund: refers to the rural broadband fund established by Indiana Code 4-4-41-2
  • fund: refers to the spinal cord and brain injury fund established by section 3 of this chapter. See Indiana Code 16-41-42.2-2
  • fund: refers to the residential water testing fund established by section 3 of this chapter. See Indiana Code 16-41-44-2
  • governing body: means the following:

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.

  • health care entity: means an entity that:

  • hemophilia: means a bleeding tendency resulting from a genetically determined deficiency factor in the blood. See Indiana Code 16-41-18-2
  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5
  • hospital: has the meaning set forth in Indiana Code 16-41-12-6
  • in writing: include printing, lithographing, or other mode of representing words and letters. See Indiana Code 1-1-4-5
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • industrialized residential structure: means a structure that is both an industrialized building system (as defined in IC 22-12-1-14) and a one (1) or two (2) family private residence. See Indiana Code 16-41-27-2.1
  • infectious waste: means waste that epidemiologic evidence indicates is capable of transmitting a serious communicable disease (as set forth in the list published under IC 16-41-2-1). See Indiana Code 16-41-16-4
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Local agency: means an administration, agency, authority, board, bureau, commission, committee, council, department division, institution, office, officer, service, or other similar body of a political subdivision created or established pursuant to law. See Indiana Code 4-6-3-1
  • local health department: refers to :

  • manufacture: means making, remaking, or renovating. See Indiana Code 16-41-32-7
  • manufactured home: has the meaning set forth in IC 22-12-1-16. See Indiana Code 16-41-27-3.5
  • medical record: means written or printed information possessed by a provider (as defined in Ind. See Indiana Code 1-1-4-5
  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • mobile home: means a dwelling, including the equipment sold as a part of the dwelling, that:

  • mobile home community: means one (1) or more parcels of land:

  • Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
  • new: means an article of bedding or filling material that has not been previously used for any purpose. See Indiana Code 16-41-32-8
  • nonpublic school: has the meaning set forth in IC 20-18-2-12. See Indiana Code 16-41-37.5-0.3
  • Oath: includes "affirmation" and "to swear" includes to "affirm". See Indiana Code 1-1-4-5
  • Oath: A promise to tell the truth.
  • office: refers to the office of community and rural affairs established by Indiana Code 4-4-41-4
  • operator: means an owner or the owner's agent of a bed and breakfast establishment who resides within the establishment or on contiguous property. See Indiana Code 16-41-31-4
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means a human being, an incorporated or unincorporated organization, or association, a trustee or legal representative, the state of Indiana, a political subdivision, a state or local agency, or a group of such persons acting in concert. See Indiana Code 4-6-3-1
  • Personal property: includes goods, chattels, evidences of debt, and things in action. See Indiana Code 1-1-4-5
  • Personal property: All property that is not real property.
  • pest: means an arthropod, a vertebrate, or a microorganism of health significance to humans. See Indiana Code 16-41-33-1
  • physician: has the meaning set forth in Indiana Code 16-41-12-7
  • Political subdivision: means a county, township, city, town, municipal corporation as defined in IC 36-1-2-10, or a special taxing district. See Indiana Code 4-6-3-1
  • Population: has the meaning set forth in Ind. See Indiana Code 1-1-4-5
  • post-organ transplant program: refers to a program established by the state department to pay recipients eligible under this chapter for costs of immunosuppressive drugs prescribed exclusively for the maintenance of individuals who undergo the transplant of an internal organ, including a heart, lung, liver, or kidney, if the costs of the drugs are not reimbursed from other sources.   • potentially disease transmitting offense: means any of the following:

  • practitioner: means a person who:

  • preschool: has the meaning set forth in Indiana Code 16-41-21.2-3
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Pro se: A Latin term meaning "on one's own behalf"; in courts, it refers to persons who present their own cases without lawyers.
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • program: refers to the Indiana broadband connectivity program established by section 7 of this chapter. See Indiana Code 4-4-41-5
  • program: means a syringe exchange program operated under this chapter. See Indiana Code 16-41-7.5-2
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • public school: has the meaning set forth in IC 20-18-2-15(1). See Indiana Code 16-41-37.5-0.5
  • publicly owned treatment works: means a treatment works, as defined in Section 212(2) of the federal Clean Water Act (33 U. See Indiana Code 16-41-25.5-2
  • qualified entity: means any of the following:

  • Quorum: The number of legislators that must be present to do business.
  • radiation: means the following:

  • radiation machine: is a ny equipment or device that produces ionizing radiation when the associated control devices are operated. See Indiana Code 16-41-35-9
  • radioactive material: is a ny solid, liquid, or gas material that emits radiation spontaneously. See Indiana Code 16-41-35-10
  • radon gas: means the radioactive gas and related decay products produced by the disintegration of the element radium. See Indiana Code 16-41-38-1
  • recreational vehicle: means a vehicle with or without motive power that is equipped to be used exclusively as living quarters for persons traveling upon the highways. See Indiana Code 16-41-27.5-3
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • residential onsite sewage system: means all equipment and devices necessary for proper conduction, collection, storage, treatment, and onsite disposal of sewage from:

  • RV campground: means an area containing at least two (2) RV campsites. See Indiana Code 16-41-27.5-4

  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • shaken baby syndrome: refers to the vigorous shaking of an infant or a young child that may:

  • Sheriff: means the sheriff of the county or another person authorized to perform sheriff's duties. See Indiana Code 1-1-4-5
  • standard licensed diagnostic test for HIV: means a test recognized by the state department as a standard licensed diagnostic test for the antibody or antigen to HIV. See Indiana Code 16-41-6-0.5
  • standard serological test for syphilis: means a test recognized as a standard serological test for syphilis by the state department. See Indiana Code 16-41-15-2
  • State agency: means an administration, agency, authority, board, bureau, commission, committee, council, department, division, institution, office, officer, service, or other similar body of state government created or established pursuant to law. See Indiana Code 4-6-3-1
  • state agency: has the meaning set forth in IC 4-13-1-1(b). See Indiana Code 16-41-37.5-1.3
  • Statute: A law passed by a legislature.
  • storage facility: has the meaning set forth in Indiana Code 16-41-12-9
  • Subpoena: A command to a witness to appear and give testimony.
  • surgeon: has the meaning set forth in Indiana Code 16-41-12-10
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • unit: means a city, town, or county. See Indiana Code 16-41-22-4
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • universal precautions: means procedures specified by rule adopted by the state department under IC 4-22-2 that are used to prevent the transmission of serious communicable diseases through blood or other body fluids. See Indiana Code 16-41-11-3
  • unnecessary radiation: means the use of radiation in a manner that is injurious or dangerous to health, life, or property. See Indiana Code 16-41-35-14
  • vector: means an arthropod or a feral animal responsible for the transmission of pathogens from a host to another animal or human. See Indiana Code 16-41-33-2
  • Venue: The geographical location in which a case is tried.
  • Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
  • waste blood specimen: means a blood sample or a solid, liquid, or semiliquid blood product that:
