  • administrative law judge: means an individual who presides over an administrative proceeding that results in a finding of fact determining the legal rights, duties, or privileges of a party after an opportunity for an evidentiary hearing. See Indiana Code 4-15-10.5-3
  • advisory board: refers to the advisory board for the principal institute established by this chapter. See Indiana Code 21-41-11-1
  • Affected class: means :

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmative action policy: means the state's affirmative action policy established in section 2 of this chapter. See Indiana Code 4-15-12-1
  • Agency: means any state administration, agency, authority, board, bureau, commission, committee, council, department, division, institution, office, service, or other similar body of state government created or established by law. See Indiana Code 4-15-10-1
  • agency: means an authority, board, branch, bureau, commission, committee, council, department, division, office, service, or other instrumentality of the executive, including the administrative, department of state government. See Indiana Code 4-15-10.5-4
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • appointing authority: means the head of a department, division, board, or commission, or an individual or group of individuals who have the power by law or by lawfully delegated authority to make appointments to positions in the state civil service. See Indiana Code 4-15-2.2-2
  • Appointing authority: means the individual or group of individuals who have the power by law or by lawfully delegated authority to make appointment to a position in an agency. See Indiana Code 4-15-10-1
  • Appraisal: A determination of property value.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • armed forces: has the meaning set forth in IC 10-17-12-2. See Indiana Code 21-41-10-2
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attorney: includes a counselor or other person authorized to appear and represent a party in an action or special proceeding. See Indiana Code 1-1-4-5
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • benefit: means any of the following:

  • Bequest: Property gifted by will.
  • board of trustees: refers to the board of trustees of Purdue University. See Indiana Code 21-39-7-1
  • bone marrow: means the soft material that fills human bone cavities. See Indiana Code 4-15-16-3
  • cabinet: means the governor's workforce cabinet established in IC 4-3-27-3. See Indiana Code 21-43-9-1
  • campus community: means :

  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • certified disaster service volunteer: means an individual who has:

  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • class of positions: means a group of positions in the state civil service determined by the director to have sufficiently similar duties, authority, and responsibility such that:

  • classified employee: means an employee who:

  • commission: refers to the state employees appeals commission created by Indiana Code 4-15-2.2-5
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • coordinator: refers to a program coordinator designated under section 10 of this chapter. See Indiana Code 21-41-10-3
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • department: means the department of education established by IC 20-19-3-1. See Indiana Code 21-43-9-2
  • department: refers to the state personnel department established by section 13 of this chapter. See Indiana Code 4-15-2.2-6
  • Devise: To gift property by will.
  • director: refers to the state personnel director appointed under section 14 of this chapter. See Indiana Code 4-15-2.2-7
  • director: means the director of the office of administrative law proceedings. See Indiana Code 4-15-10.5-5
  • disaster: means an event that is designated under the American National Red Cross Regulations and Procedures to be at least as serious as a level III disaster and is proclaimed by the governor as a disaster warranting the leave allowed under this chapter. See Indiana Code 4-15-14-2
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • division of the service: means any of the following that are subject to this chapter and whose positions are under the same appointing authority:

  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Employee: means an employee of an agency except an elected official. See Indiana Code 4-15-10-1
  • employee: means a person who is employed full time by a state agency. See Indiana Code 4-15-14-3
  • employee: means a person who is employed full time by a state agency. See Indiana Code 4-15-16-4
  • employee organization: means an entity that works in whole or in part for the common interest of employees. See Indiana Code 4-15-17-2
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiduciary: A trustee, executor, or administrator.
  • fire and safety personnel: means individuals employed by Purdue University at the West Lafayette campus as firefighters or safety personnel to render fire suppression, fire prevention, emergency response, and emergency medical services on campus. See Indiana Code 21-39-7-2
  • fire department: means a fire department established by the board of trustees to render fire suppression, fire prevention, and related services on the West Lafayette campus of Purdue University. See Indiana Code 21-39-7-3
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

  • institute: refers to the principal institute established by section 4 of this chapter. See Indiana Code 21-41-11-2
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Judgment: means all final orders, decrees, and determinations in an action and all orders upon which executions may issue. See Indiana Code 1-1-4-5
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • materially and substantially disrupt: means the act of knowingly or intentionally doing one (1) or more of the following:

  • medical record: means written or printed information possessed by a provider (as defined in Ind. See Indiana Code 1-1-4-5
  • military service: means service performed while an active member of any of the following:

  • minor: means a person less than eighteen (18) years of age. See Indiana Code 1-1-4-5
  • Minorities: means persons identified as Blacks, Native Americans, Asian Americans, and Hispanics. See Indiana Code 4-15-12-1

  • monetize: refers to an exchange of part or all of the possession and control of a capital asset or security of a state educational institution, without a transfer of ownership, for a period of time in return for cash or future revenue as specified in a written agreement between the state educational institution and a third party.   • Month: means a calendar month, unless otherwise expressed. See Indiana Code 1-1-4-5
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.

  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • office: means the office of administrative law proceedings established by section 7 of this chapter. See Indiana Code 4-15-10.5-6
  • Office: means the Indiana affirmative action office created by this chapter. See Indiana Code 4-15-12-1
  • officer or employee of the state: means the following:

  • organ: means a lung, a kidney, or another organ that requires the continuous circulation of blood to remain useful for purposes of transplantation. See Indiana Code 4-15-16-5
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Personal property: includes goods, chattels, evidences of debt, and things in action. See Indiana Code 1-1-4-5
  • Personal property: All property that is not real property.
  • Persons with disabilities: means all persons who by reason of physical or mental disability are unable to achieve full vocational participation. See Indiana Code 4-15-12-1
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Population: has the meaning set forth in Ind. See Indiana Code 1-1-4-5
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • program: refers to the combat to college program established under section 8 of this chapter. See Indiana Code 21-41-10-6
  • program: refers to the second service for veterans program established by section 3 of this chapter. See Indiana Code 21-41-12-1
  • Property: includes personal and real property. See Indiana Code 1-1-4-5
  • protected expressive activity: includes the following:

  • Quorum: The number of legislators that must be present to do business.
  • real property: include lands, tenements, and hereditaments. See Indiana Code 1-1-4-5
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Red Cross: means the American National Red Cross created under 36 U. See Indiana Code 4-15-14-4
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.

  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.

  • state agency: means an authority, board, branch, commission, committee, department, division, or other instrumentality of state government that is subject to this chapter. See Indiana Code 4-15-2.2-9

  • Subpoena: A command to a witness to appear and give testimony.
  • Supervisor: means an individual who oversees the daily activity of an employee. See Indiana Code 4-15-10-1
  • task force: refers to the 21st century energy policy development task force established by section 2 of this chapter. See Indiana Code 2-5-45.1-1
  • task force: refers to the health care cost oversight task force established by section 4 of this chapter. See Indiana Code 2-5-47-2
  • task force: refers to the drainage task force established by section 2 of this chapter. See Indiana Code 2-5-51-1
  • Testator: A male person who leaves a will at death.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trustee: A person or institution holding and administering property in trust.
  • Underutilization: means having fewer members of an affected class in a particular job category and classification than would be reasonably expected by their availability in the labor market for that job category and classification. See Indiana Code 4-15-12-1
  • United States: includes the District of Columbia and the commonwealths, possessions, states in free association with the United States, and the territories. See Indiana Code 1-1-4-5
  • university: refers to Indiana State University. See Indiana Code 21-41-11-3
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Verified: when applied to pleadings, means supported by oath or affirmation in writing. See Indiana Code 1-1-4-5
  • veteran: includes "Hoosier veteran" and applies to the construction of all Indiana statutes, unless the construction is expressly excluded by the terms of the statute, is plainly repugnant to the intent of the general assembly or of the context of the statute, or is inconsistent with federal law.
