Terms Used In Iowa Code 633.264

  • Charges: includes costs of administration, funeral expenses, cost of monument, and federal estate taxes. See Iowa Code 633.3
  • Debts: includes liabilities of the decedent which survive, whether arising in contract, tort, or otherwise. See Iowa Code 633.3
  • Estate: means the real and personal property of either a decedent or a ward, and may also refer to the real and personal property of a trust described in section 633. See Iowa Code 633.3
  • Full age: means the state of legal majority attained through arriving at the age of eighteen years or through having married, even though such marriage is terminated by divorce. See Iowa Code 633.3
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, or government; governmental subdivision, agency, or instrumentality; or any other legal or commercial entity. See Iowa Code 633.701
  • Property: includes both real and personal property. See Iowa Code 633.3
  • Surviving spouse: means the surviving wife or husband, as the case may be. See Iowa Code 633.3
 Subject to the rights of the surviving spouse to take an elective share as provided by section 633.236, any person of full age and sound mind may dispose by will of all the person’s property, except an amount sufficient to pay the debts and charges against the person’s estate.
