Terms Used In Iowa Code 633.318

  • Court: means , when referring to a court of this state, the district court sitting in probate with jurisdiction of conservatorships and guardianships. See Iowa Code 633.701
  • Decedent: A deceased person.
  • Letters: includes letters testamentary, letters of administration, letters of guardianship, letters of conservatorship, and letters of trusteeship. See Iowa Code 633.3
  • Probate: Proving a will
 If, after a will has been admitted to probate, another instrument purporting to be the will of the decedent, which has not been previously presented for probate, is filed, the court shall determine whether or not the former grant of letters should be revoked pending determination of which instrument constitutes the will of the decedent.
