Terms Used In Iowa Code > Chapter 578A - Self-Service Storage Facilities

  • Advertisement: means an attempt by publication, dissemination, solicitation, or circulation to induce directly or indirectly any person to enter into an obligation or acquire a title or interest in a membership camping contract. See Iowa Code 557B.1
  • Commercially reasonable sale: means a sale that is conducted at the self-service storage facility, at the nearest suitable place to where the personal property is held or stored, or on a publicly accessible internet site that conducts sales or auctions. See Iowa Code 578A.2
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Contract: A legal written agreement that becomes binding when signed.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Default: means the failure by the occupant to perform on time any obligation or duty set forth in a rental agreement or this chapter. See Iowa Code 578A.2
  • Emergency: means any sudden, unexpected occurrence or circumstance at or near a self-service storage facility that requires immediate action to avoid injury to persons or property at or near the self-service storage facility, including a fire. See Iowa Code 578A.2
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
  • Last-known address: means the postal address or electronic mail address provided by an occupant in a rental agreement or the postal address or electronic mail address provided by the occupant in a subsequent written notice of a change of address. See Iowa Code 578A.2
  • Late fee: means any fee or charge assessed for an occupant's failure to pay rent when due. See Iowa Code 578A.2
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Leased space: means individual storage space at a self-service storage facility which is rented to an occupant pursuant to a rental agreement. See Iowa Code 578A.2
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Occupant: means a person entitled to the use of leased space at a self-service storage facility under a rental agreement or the person's successors or assigns. See Iowa Code 578A.2
  • Offer: means an inducement, solicitation, or attempt to encourage a person to acquire a membership camping contract. See Iowa Code 557B.1
  • Operator: means the owner, operator, lessor, or sublessor of a self-service storage facility or an agent or any other person authorized to manage the facility. See Iowa Code 578A.2
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Personal property: means movable property not affixed to land, including goods, wares, merchandise, motor vehicles, watercraft, household items, and furnishings. See Iowa Code 578A.2
  • Personal property: All property that is not real property.
  • property: includes personal and real property. See Iowa Code 4.1
  • Property that has no commercial value: means property offered for sale in a commercially reasonable sale that receives no bid or offer. See Iowa Code 578A.2
  • Purchaser: means a person who enters into a membership camping contract with a membership camping operator and obtains the right to use the campground owned or operated by the membership camping operator. See Iowa Code 557B.1
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Rental agreement: means an agreement or lease, written or oral, that establishes or modifies the terms, conditions, or rules concerning the use and occupancy of leased space at a self-service storage facility. See Iowa Code 578A.2
  • Self-service storage facility: means real property designed and used for the purpose of renting or leasing individual storage space to occupants who are to have access to the space for the purpose of storing personal property. See Iowa Code 578A.2
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • Statute: A law passed by a legislature.
  • United States: includes all the states. See Iowa Code 4.1
  • Verified mail: means any method of mailing offered by the United States postal service or private delivery service that provides evidence of the mailing. See Iowa Code 578A.2
