Terms Used In Iowa Code > Chapter 716B - Hazardous Waste Offenses

  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of natural resources. See Iowa Code 716B.1
  • dispose: means disposal as defined in section 455B. See Iowa Code 716B.1
  • Hazardous waste: means a hazardous waste as defined in section 455B. See Iowa Code 716B.1
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an agency of the state or federal government, a municipality, governmental subdivision, interstate body, public or private corporation, individual, partnership, or other entity, and includes an officer, or governing or managing body of a municipality, governmental subdivision, interstate body, or public or private corporation. See Iowa Code 716B.1
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • store: means the containment of a hazardous waste, either on a temporary basis or for a period of years, in a manner that does not constitute disposal of the hazardous waste. See Iowa Code 716B.1
  • treat: means a method, technique, or process, including neutralization, designed to change the physical, chemical, or biological character or composition of a hazardous waste so as to neutralize the waste or to render the waste nonhazardous, safer for transport, amenable for recovery, amenable for storage, or to reduce the waste in volume. See Iowa Code 716B.1
  • Treatment: includes any activity or processing designed to change the physical form or chemical composition of hazardous waste to render the waste nonhazardous. See Iowa Code 716B.1
  • United States: includes all the states. See Iowa Code 4.1
