(a) The commercial industrial hemp act licensing fee fund shall be administered by the secretary of agriculture. All expenditures from the commercial industrial hemp act licensing fee fund shall be made in accordance with appropriation acts upon warrants of the director of accounts and reports issued pursuant to vouchers signed by the secretary of agriculture or the secretary’s designee.

(b) Except as provided in Kan. Stat. Ann. § 2-3907, and amendments thereto, licensing and renewal fees shall be established pursuant to rules and regulations adopted by the secretary under the commercial industrial hemp act. The amounts received for such fees shall be deposited in the state treasury in accordance with Kan. Stat. Ann. § 75-4215, and amendments thereto, and shall be credited to the commercial industrial hemp act licensing fee fund.
