Terms Used In Kansas Statutes 65-1,171

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Health care provider: means a person licensed to practice medicine and surgery, a hospital or ambulatory surgery center, as defined in Kan. See Kansas Statutes 65-1,168
  • Secretary: means the secretary of health and environment. See Kansas Statutes 65-1,114
  • Subpoena: A command to a witness to appear and give testimony.

The information contained on the cancer registry shall be confidential, shall not be disclosed except as provided in Kan. Stat. Ann. § 65-1,172 and amendments thereto, shall not be subject to subpoena, discovery or introduction into evidence in any civil or criminal proceeding and shall not be subject to the provisions of the Kansas open records act. The secretary shall ensure that the confidentiality of any data collected which might be used to identify an individual with cancer or a health care provider is maintained. Storage of cancer data shall be in a manner which will protect all information which uniquely identifies individuals.
