Terms Used In Kansas Statutes 72-263

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Kansas Statutes 77-201
  • State board: means the state board of education created by sections 2 and 3 of article 6 of the constitution and provided for by Kan. See Kansas Statutes 72-244

Whenever a hearing officer appointed under authority of Kan. Stat. Ann. § 72-262, and amendments thereto, hears any appeal, case or other matter, the hearing officer, after hearing the same, shall render an initial order which shall be subject to review by the state board of education. Any matter determined by the state board of education in accordance with this section shall be valid to the same extent as if the matter were fully heard by the state board of education without a hearing officer.
