(1) After reasonable notice and opportunity to be heard in accordance with KRS Chapter 13A, the commissioner, upon advisement and subject to comment by the committee under the requirements of KRS § 198B.030(8) shall, by administrative regulation, fix reasonable standards for the safe construction, installation, inspection, and repair of boilers, pressure vessels, and associated pressure piping in this state. Administrative regulations shall be enforced by the Department of Housing, Buildings and Construction, Division of Plumbing.
(2) The department may adopt any other administrative regulation necessary to administer this chapter if the regulation has been subject to review and comment by the committee under the requirements of KRS § 198B.030(8).

Terms Used In Kentucky Statutes 236.030

  • Administrative regulation: means an administrative regulation adopted by the department and filed and approved in accordance with KRS Chapter 13A that is designed to ensure the safety of boilers and pressure vessels that affects or may affect property rights of a designated class of owners, or designed for the prevention of loss or damage to property, loss of life, or personal injury from boiler or pressure vessel explosion or from certain indicated hazards related thereto.   • boilers: means and includes a closed vessel in which water or other liquid is heated, steam or vapor is generated, steam is superheated, or in which any combination of these functions is accomplished, under pressure or vacuum, for use externally to itself, by the direct application of energy from the combustion of fuels, or from electricity, solar or nuclear energy.   • Commissioner: means the commissioner of Department of Housing, Buildings and Construction. See Kentucky Statutes 236.010
  • Department: means the Department of Housing, Buildings and Construction. See Kentucky Statutes 236.010
  • Division: means the Division of Plumbing in the department. See Kentucky Statutes 236.010
  • State: when applied to a part of the United States, includes territories, outlying possessions, and the District of Columbia. See Kentucky Statutes 446.010
