(1) The owner or user of a boiler or pressure vessel required by this chapter to be inspected shall pay to the department, upon completion of inspection, reasonable fees not to exceed the cost of inspection as established by the commissioner in an administrative regulation promulgated in accordance with KRS Chapter 13A.
(2) All other inspections, including shop inspections and inspection of secondhand or used boilers made by the boiler inspector shall be charged for at the rate set by administrative regulation promulgated by the commissioner in accordance with KRS Chapter 13A.

Terms Used In Kentucky Statutes 236.130

  • Administrative regulation: means an administrative regulation adopted by the department and filed and approved in accordance with KRS Chapter 13A that is designed to ensure the safety of boilers and pressure vessels that affects or may affect property rights of a designated class of owners, or designed for the prevention of loss or damage to property, loss of life, or personal injury from boiler or pressure vessel explosion or from certain indicated hazards related thereto.   • boiler: shall include fired units for heating or vaporizing liquids other than water where these units are separate from processing systems and are complete within themselves:
    (a) "Power boiler" means a boiler in which steam or other vapor is generated at a pressure of more than fifteen (15) pounds per square inch gauge. See Kentucky Statutes 236.010
  • Boiler inspector: means a duly authorized employee of the department who is charged with the responsibility of inspecting boilers and pressure vessels and with the enforcement of the state boiler laws. See Kentucky Statutes 236.010
  • boilers: means and includes a closed vessel in which water or other liquid is heated, steam or vapor is generated, steam is superheated, or in which any combination of these functions is accomplished, under pressure or vacuum, for use externally to itself, by the direct application of energy from the combustion of fuels, or from electricity, solar or nuclear energy. See Kentucky Statutes 236.010
  • Commissioner: means the commissioner of Department of Housing, Buildings and Construction. See Kentucky Statutes 236.010
  • Department: means the Department of Housing, Buildings and Construction. See Kentucky Statutes 236.010
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Owner: when applied to any animal, means any person having a property interest in such animal. See Kentucky Statutes 446.010
  • Pressure vessel: means a vessel in which the pressure is obtained from an external source or by the application of heat other than those vessels defined in subsection (1) of this section. See Kentucky Statutes 236.010

(3) All fees received by the department shall be held in a trust and agency fund from which the expenses of administering this chapter and other department responsibilities may be paid, and no portion of the fund shall lapse into the general fund at the end of each fiscal year.
