(1) As used in this section, “provider-sponsored integrated health delivery network” has the same meaning as in KRS § 304.17A-005.
(2) A provider-sponsored integrated health delivery network may elect to convert to a health maintenance organization under KRS § 304.38-070(5) by filing an election to convert with the commissioner that contains a notification of the network’s effective date of conversion.

Terms Used In Kentucky Statutes 304.38-042

  • Commissioner: means the commissioner of the Department of Insurance. See Kentucky Statutes 304.38-030
  • Health maintenance organization: means any person who undertakes to provide, directly or through arrangements with others, health care services to individuals enrolled with such an organization on a per capita or a predetermined, fixed prepayment basis. See Kentucky Statutes 304.38-030
  • Statute: A law passed by a legislature.

(3) Within thirty (30) days of the date of an election filing under subsection (2) of this section, the commissioner shall issue a certificate of authority as a health maintenance organization under KRS § 304.38-070(5) to the provider-sponsored integrated health delivery network unless the commissioner:
(a) Finds that, at the time of the election, the provider-sponsored integrated health delivery network fails to meet the net worth requirements of KRS § 304.38-
070(5)(b); and
(b) Provides the provider-sponsored integrated health delivery network with a written notice of the determination that contains a notice of the network’s rights under KRS § 304.2-310.

In codification, a correction has been made to subsection (1) of this statute. 2022 House Bill 350, which created this statute, included a definition of “provided-sponsored integrated health delivery network”. However, it is clear from the context and from the reference to the definition of “provider-sponsored integrated health delivery network” found in KRS
304.17-005 that the defined term in subsection (1) of this statute was intended to read
“provider-sponsored integrated health delivery network”. Under the authority of KRS
7.136, the Reviser of Statutes has corrected this manifest typographical error.
