  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.

Upon the filing of a petition for a writ of mandamus, the court shall order the issuance of an alternative writ directing the defendant to perform the act demanded or to show cause to the contrary.
