Terms Used In Louisiana Revised Statutes 17:350.21

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

            A.(1) Any elementary or secondary school operated by Louisiana State University and Agricultural and Mechanical College, Southern University and Agricultural and Mechanical College, the University of Louisiana at Lafayette, or the University of Louisiana at Monroe shall be considered a public elementary or secondary school and, as such, shall be annually appropriated funds as determined by applying the formula as specified in Subsection B of this Section.

            (2) Any school provided for in this Section shall be authorized by the board of supervisors with jurisdiction over the public postsecondary institution operating the school.

            B. Each student, as identified by the preceding year’s October first membership, enrolled in a school provided for in Subsection A of this Section shall be provided for and funded as provided for in La. Const. Art. VIII, § 13 . The State Board of Elementary and Secondary Education shall allocate annually from the minimum foundation program formula an amount per student to each school equal to the amount allocated per student to the school board in the parish where the school is located.

            C.(1) The funds appropriated for the schools provided for in this Section shall be allocated to the institution of postsecondary education operating the school, and each institution shall expend such funds to operate the school.

            (2) No funds allocated pursuant to this Subsection shall be expended to operate the school unless the public postsecondary education institution operating the school has secured the necessary educational facilities, including classroom capacity, either through the use of current resources or private donations, or if expressly provided for by an Act of the legislature.

            D. The funds provided pursuant to this Section during any one fiscal year shall not supplant funding provided by a postsecondary education institution for the previous fiscal year to any elementary or secondary school operated by the institution.

            E. Notwithstanding any provision of this Section to the contrary, the funding provided pursuant to this Section shall not exceed the average per pupil funding provided by the minimum foundation program formula for other elementary or secondary schools operated by public postsecondary education institutions.
