Terms Used In Louisiana Revised Statutes 36:259

  • Office: means each principal operational unit within a department, except the executive office of the secretary. See Louisiana Revised Statutes 36:3
  • Secretary: means the officer appointed by the governor as the executive head and chief administrative officer of certain departments created and provided for by this Title. See Louisiana Revised Statutes 36:3

            A. The following agencies are transferred to and hereafter shall be within the Louisiana Department of Health as provided in La. Rev. Stat. 36:803:

            (1) Louisiana State Board of Dentistry (La. Rev. Stat. 37:751 et seq.).

            (2) Louisiana State Board of Embalmers and Funeral Directors (La. Rev. Stat. 37:831 et seq.).

            (3) Louisiana State Board of Nursing (La. Rev. Stat. 37:911 et seq.).

            (4) Louisiana State Board of Practical Nurse Examiners (La. Rev. Stat. 37:961 et seq.).

            B. The following agencies are placed within the Louisiana Department of Health and shall exercise and perform their powers, duties, functions, and responsibilities as otherwise provided by law:

            (1) Louisiana state office of rural health (La. Rev. Stat. 40:2195.1).

            (2) Louisiana State Child Death Review Panel (La. Rev. Stat. 40:2019).

            (3) Marriage and Family Therapy Advisory Committee (La. Rev. Stat. 37:1104) (Established by the Louisiana Licensed Professional Counselors Board of Examiners).

            (4) Nursing Home Emergency Preparedness Review Committee (La. Rev. Stat. 40:2009.25).

            (5) Advisory Committee on Polysomnography (La. Rev. Stat. 37:2861 et seq.).

            (6) Louisiana Birth Defects Surveillance System Advisory Board (La. Rev. Stat. 40:31.41 et seq.).

            (7) Prescription Monitoring Program Advisory Council (La. Rev. Stat. 40:1001 et seq.).

            (8) Health Data Panel (La. Rev. Stat. 40:1173.1 et seq.).

            (9) Medicaid Pharmaceutical and Therapeutics Committee (La. Rev. Stat. 46:153.3).

            (10) Advisory council for the program of early identification of deaf or hard of hearing infants (La. Rev. Stat. 46:2261 et seq.).

            (11) Louisiana Sickle Cell Commission (La. Rev. Stat. 40:1125.1).

            (12) Physician Assistants Advisory Committee (La. Rev. Stat. 37:1270.1).

            (13) Respiratory Care Advisory Committee (La. Rev. Stat. 37:3356 et seq.).

            (14) Louisiana Advisory Committee on Populations and Geographic Regions With Excessive Cancer Rates (La. Rev. Stat. 40:1105.12).

            (15)(a) Louisiana Developmental Disabilities Council (La. Rev. Stat. 28:750 et seq.). The council shall have full appointing authority for all personnel purposes.

            (b) Regional and state advisory councils for the Community and Family Support System (La. Rev. Stat. 28:824(J)).

            (16) Louisiana Commission on HIV and Hepatitis C Education, Prevention, and Treatment (La. Rev. Stat. 40:2018.1).

            (17) Palliative Care Interdisciplinary Advisory Council (La. Rev. Stat. 40:2018.7).

            (18) Louisiana Toxic Mold Task Force (La. Rev. Stat. 40:1289.1 et seq.).

            (19) Louisiana Community Health Worker Workforce Board (La. Rev. Stat. 37:3721 et seq.).

            (20) through (38) Repealed by Acts 2022, No. 623, §9, eff. July 1, 2022.

            C. The following agencies are transferred to and hereafter shall be within the Louisiana Department of Health as provided in La. Rev. Stat. 36:851 et seq.:

            (1) Eastern Louisiana Mental Health System (Jackson).

            (2) Central Louisiana State Hospital (Pineville).

            (3) Pinecrest Supports and Services Center (La. Rev. Stat. 28:22.8(A)(1); La. Rev. Stat. 28:451.4).

            (4) North Lake Supports and Services Center (La. Rev. Stat. 28:22.8(A)(3); La. Rev. Stat. 28:451.4).

            (5) The behavioral health facilities located in New Orleans, Baton Rouge, Shreveport, Monroe, Lake Charles, Alexandria, Lafayette, Metairie, Hammond, Natchitoches, Ruston, Chalmette, Houma, Harvey, Marksville, Bogalusa, Pineville, Many, New Roads, Covington, Crowley, Donaldsonville, Plaquemine, Raceland, Leesville, Norco, Mandeville, Ville Platte, Patterson, Tallulah, Columbia, Oakdale, and any other state-owned or state-operated facilities as may be hereinafter established (La. Rev. Stat. 28:22.5).

            (6) Northwest Supports and Services Center (La. Rev. Stat. 28:22.8(A)(2); La. Rev. Stat. 28:451.4).

            (7) Villa Feliciana Medical Complex (La. Rev. Stat. 28:22.7; La. Rev. Stat. 40:2002.4; La. Rev. Stat. 40:2142).

            (8) Central Louisiana Supports and Services Center (La. Rev. Stat. 28:22.8).

            D. The following agencies are placed within the Louisiana Department of Health and shall exercise and perform their powers, duties, functions, and responsibilities in accordance with the provisions of La. Rev. Stat. 36:802:

            (1) Commission on Perinatal Care and Prevention of Infant Mortality (La. Rev. Stat. 40:2018).

            (2) Governor’s Council on Physical Fitness and Sports (La. Rev. Stat. 40:2451 et seq.).

            (3) Healthy Moms, Healthy Babies Advisory Council (La. Rev. Stat. 40:2018.5).

            (4) Louisiana Commission for the Deaf (La. Rev. Stat. 46:2351 et seq.).

            (5) Louisiana Medical Disclosure Panel (La. Rev. Stat. 40:1157.2).

            (6) Water Supply and Sewerage Systems Certification Committee (La. Rev. Stat. 40:1281.1 et seq.).

            (7) Louisiana Rare Disease Advisory Council (La. Rev. Stat. 40:1122.1).

            NOTE: Paragraph (D)(8) shall not become effective unless and until sufficient funds become available through nongovernmental sources or are specifically appropriated by the legislature. See Acts 2021, No. 320 and Acts 2022, No. 623, §§8 and 13(B).

            (8) Louisiana Domestic Abuse Fatality Review Panel (La. Rev. Stat. 40:2024.1 et seq.).

            E. The Louisiana Emergency Response Network Board (La. Rev. Stat. 40:2841 et seq.) is placed within the Louisiana Department of Health and shall exercise and perform its powers, duties, functions, and responsibilities as provided in La. Rev. Stat. 36:801.1. The Louisiana Emergency Response Network Board shall be a separate budget unit within the Louisiana Department of Health.

            F. The following agencies are hereby placed within the Louisiana Department of Health and shall exercise and perform their powers, duties, functions, and responsibilities in accordance with the provisions of La. Rev. Stat. 36:901 et seq.:

            (1) Traumatic Head and Spinal Cord Injury Trust Fund Advisory Board (La. Rev. Stat. 46:2631 et seq.).

            (2) Clinical Laboratory Personnel Committee (La. Rev. Stat. 37:1311 et seq.), except that the committee may conduct examinations and may appoint and employ such personnel as required or authorized, as provided by La. Rev. Stat. 37:1315.

            (3) Louisiana Emergency Medical Services Certification Commission (La. Rev. Stat. 40:1131 et seq.), except that the commission shall advise the bureau of emergency medical services on requirements and standards for licensure of emergency medical personnel and continuing education requirements for licensure. The commission shall retain the authority to approve requirements and standard of practice for emergency medical personnel; conduct disciplinary hearings for emergency medical personnel; and cause the prosecution of any individual who violates the provisions of Part II of Chapter 5-C of Title 40 of the Louisiana Revised Statutes of 1950.

            G. The following agencies, previously abolished by the Executive Reorganization Act, and their powers, duties, functions and responsibilities are transferred to the secretary of the Louisiana Department of Health and shall be exercised and performed as provided in La. Rev. Stat. 36:921 et seq.:

            (1) Anatomical Board (La. Rev. Stat. 17:2271 et seq.).

            (2) Louisiana State Board of Health and the Louisiana Department of Health and all its subsidiary boards. (Such provisions of Title 40 of the Louisiana Revised Statutes of 1950 as are applicable to the abolished board and department).
