Terms Used In Louisiana Revised Statutes 40:1603

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Person: means an individual, association, joint venture, partnership, corporation, limited liability company, political subdivision, municipality, or public or private organization of any character, including any agency, department, board, bureau, office, commission, district, corporation, and quasi-public corporation of the federal, state, municipal, or local government. See Louisiana Revised Statutes 40:1615

            A. As used in this Section, the following terms shall have the meaning ascribed as follows:

            (1) “Fire-resistant material” means cementitious or fibrous materials that are sprayed onto a surface to provide fire-resistant protection of the substrate.

            (2) “Fire-resistant material applicator” means an individual who applies fire-resistant material.

            B.(1) Every fire-resistant material applicator shall undergo training to apply fire-resistant material according to manufacturer specifications.

            (2) Every fire-resistant material applicator shall annually register with the office of the state fire marshal.

            (3) When a fire-resistant material applicator satisfactorily completes training and registers as required by this Subsection, the state fire marshal shall issue a certificate which indicates that the fire-resistant material applicator is certified to apply fire-resistant material.

            C. Any person applying fire-resistant material who does not receive the training, register, and obtain a certificate as required in Subsection B of this Section shall be fined up to two hundred fifty dollars per violation.

            D. The provisions of this Section shall be implemented, including a procedure for the appeal of penalties, and enforced pursuant to the Administrative Procedure Act.
