Terms Used In Louisiana Civil Code 1472

  • Donee: The recipient of a gift.
  • Inter vivos: Transfer of property from one living person to another living person.
  • Testator: A male person who leaves a will at death.

Capacity to receive a donation inter vivos must exist at the time the donee accepts the donation.  Capacity to receive a donation mortis causa must exist at the time of death of the testator.
