Terms Used In Louisiana Civil Code 1471

  • Donor: The person who makes a gift.
  • Inter vivos: Transfer of property from one living person to another living person.
  • Testator: A male person who leaves a will at death.

Capacity to donate inter vivos must exist at the time the donor makes the donation.  Capacity to donate mortis causa must exist at the time the testator executes the testament.
