  • Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 15 Sec. 225
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Blind person: means a person having not more than 20/200 central visual acuity in the better eye after correction or an equally disabling loss of the visual field so that the widest diameter of the visual field subtends an angle no greater than 20 degrees. See Maine Revised Statutes Title 26 Sec. 1418
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Director: means the Director of the Division for the Blind and Visually Impaired. See Maine Revised Statutes Title 26 Sec. 1418
  • Division: means the Division for the Blind and Visually Impaired in the department. See Maine Revised Statutes Title 26 Sec. 1418
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiduciary: A trustee, executor, or administrator.
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 15 Sec. 225
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Jurisdiction: means the control of the maintenance, operation and protection of public buildings and property of the State or of a county or a municipality. See Maine Revised Statutes Title 26 Sec. 1418
  • machine gun: means a weapon of any description, by whatever name known, loaded or unloaded, which is capable of discharging a number of projectiles in rapid succession by one manual or mechanical action on the trigger or firing mechanism. See Maine Revised Statutes Title 26 Sec. 1418-B
  • Manager: means the blind person, duly licensed by the division, who personally operates the vending facility. See Maine Revised Statutes Title 26 Sec. 1418
  • Oath: includes an affirmation, when affirmation is allowed. See Maine Revised Statutes Title 15 Sec. 225
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Public building or property: means a building or land owned, leased or occupied by a department, agency or authority of the State or a county or a municipality of the State. See Maine Revised Statutes Title 26 Sec. 1418
  • Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust).
  • Statute: A law passed by a legislature.
  • Town: includes cities and plantations, unless otherwise expressed or implied. See Maine Revised Statutes Title 15 Sec. 225
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 15 Sec. 225
  • Vending facility: means a restaurant, a cafeteria, including the cafeteria located in the State Office Building in Augusta, a snack bar, a vending machine for food and beverages and goods and services customarily offered in connection with a restaurant, a cafeteria, a snack bar or a vending machine.
