Chapter 901 Interstate Compact On Educational Opportunity for Military Children 20101 – 20118

Terms Used In Maine Revised Statutes > Title 20-A > Part 10 - Interstate Compact On Educational Opportunity for Military Children

  • Active duty: means full-time duty status in the active uniformed service of the United States, including members of the National Guard and Reserve on active duty orders pursuant to 10 United States Code, Chapters 1209 and 1211. See Maine Revised Statutes Title 20-A Sec. 20102
  • Animal: means all vertebrate and invertebrate species, including but not limited to humans and other mammals, birds, fish and shellfish. See Maine Revised Statutes Title 7 Sec. 604
  • Child of a military family: means a school-aged child enrolled in kindergarten to grade 12 in the household of an active duty member. See Maine Revised Statutes Title 20-A Sec. 20102
  • Compact: means the Interstate Compact on Educational Opportunity for Military Children. See Maine Revised Statutes Title 20-A Sec. 20102
  • Compact commissioner: means the voting representative of each member state appointed pursuant to section 20109. See Maine Revised Statutes Title 20-A Sec. 20102
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Health and Human Services and its agents and authorized representatives. See Maine Revised Statutes Title 19-A Sec. 101
  • Department: means the Department of Education. See Maine Revised Statutes Title 20-A Sec. 1
  • Deployment: means the period one month prior to a service member's departure from the service member's home station on military orders to 6 months after return to the service member's home station. See Maine Revised Statutes Title 20-A Sec. 20102
  • Educational records: means those official records, files and data directly related to a student and maintained by the school or local education agency, including but not limited to records encompassing all the material kept in the child's cumulative folder such as general identifying data, records of attendance and of academic work completed, records of achievement and results of evaluative tests, health data, disciplinary status, test protocols and individualized education programs.   • Environment: includes water, air and land and all plants and human beings and other animals living therein and the interrelationships that exist among these. See Maine Revised Statutes Title 7 Sec. 604
  • EPA: means the United States Environmental Protection Agency. See Maine Revised Statutes Title 7 Sec. 604
  • Ex officio: Literally, by virtue of one's office.
  • Extracurricular activities: means voluntary activities sponsored by the school or local education agency or an organization sanctioned by the local education agency. See Maine Revised Statutes Title 20-A Sec. 20102
  • FIFRA: means the Federal Insecticide, Fungicide and Rodenticide Act. See Maine Revised Statutes Title 7 Sec. 604
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Interstate commission: means the Interstate Commission on Educational Opportunity for Military Children established under section 20109. See Maine Revised Statutes Title 20-A Sec. 20102
  • Kindergarten: means a one-year or 2-year childhood education program, for children at least 5 years of age, immediately prior to grade one. See Maine Revised Statutes Title 20-A Sec. 1
  • Labeling: means the label and all other written, printed or graphic matter:

  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Local education agency: means a public authority legally constituted by a member state as an administrative agency to provide control of and direction for kindergarten to grade 12 public educational institutions. See Maine Revised Statutes Title 20-A Sec. 20102
  • Member state: means a state that has enacted the compact. See Maine Revised Statutes Title 20-A Sec. 20102
  • Membership: means active participation in the program of a school from the date of enrollment to the time the student withdraws or is absent from the school for 10 consecutive days for reasons other than illness. See Maine Revised Statutes Title 20-A Sec. 15001
  • Military installation: means a base, camp, post, station, yard, center or homeport facility for any ship, or other activity under the jurisdiction of the federal Department of Defense, including any leased facility, that is located within any of the several states, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Northern Marianas Islands and any other United States territory.   • Minority: when used in reference to age shall mean under the age of 18. See Maine Revised Statutes Title 1 Sec. 72
  • Nonmember state: means a state that has not enacted the compact. See Maine Revised Statutes Title 20-A Sec. 20102
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Parent: means the legal parent or the legal guardian when no legal parent exists. See Maine Revised Statutes Title 19-A Sec. 101
  • Parent: means a parent, guardian or legal guardian. See Maine Revised Statutes Title 20-A Sec. 1
  • Pest: means any insects, rodents, nematodes, fungi, weeds, and other forms of terrestrial or aquatic plant or animal life or viruses, bacteria or other microorganisms, except viruses, bacteria or other microorganisms on or in living human beings or other living animals, that the commissioner declares to be a pest under section 610, subsection 1, paragraph A.   • Pesticide: includes a highly toxic pesticide. See Maine Revised Statutes Title 7 Sec. 604
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Principal: means the person who supervises the operation and management of a school and school property as determined necessary by the superintendent under policies established by the school board. See Maine Revised Statutes Title 20-A Sec. 1
  • Receiving state: means the state to which a child of a military family is sent, brought or caused to be sent or brought. See Maine Revised Statutes Title 20-A Sec. 20102
  • Registration: includes reregistration. See Maine Revised Statutes Title 7 Sec. 604
  • Responsible parent: means the parent of a dependent child. See Maine Revised Statutes Title 19-A Sec. 2101
  • Rule: means a written statement by the interstate commission adopted pursuant to section 20112 that is of general applicability; implements, interprets or prescribes a policy or provision of the compact or an organizational, procedural or practice requirement of the interstate commission; has the force and effect of statutory law in a member state; and includes the amendment, repeal or suspension of an existing rule.   • Sending state: means the state from which a child of a military family is sent, brought or caused to be sent or brought. See Maine Revised Statutes Title 20-A Sec. 20102
  • state: means any state, territory or possession of the United States, the Commonwealth of Puerto Rico and the District of Columbia. See Maine Revised Statutes Title 19-A Sec. 101
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Northern Marianas Islands and any other United States territory. See Maine Revised Statutes Title 20-A Sec. 20102
  • State council: means the state council on educational opportunity for military children established in section 20108. See Maine Revised Statutes Title 20-A Sec. 20102
  • Statute: A law passed by a legislature.
  • Student: means the child of a military family for whom the local education agency receives public funding and who is formally enrolled in kindergarten to grade 12. See Maine Revised Statutes Title 20-A Sec. 20102
  • Superintendent: means the person in a school administrative unit or school union appointed and having the authority and responsibility under this Title and other applicable statutes. See Maine Revised Statutes Title 20-A Sec. 1

  • Uniformed service: means the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the National Oceanic and Atmospheric Administration Commissioned Corps or the United States Public Health Service Commissioned Corps. See Maine Revised Statutes Title 20-A Sec. 20102
  • Veteran: means a person who served in the uniformed services and who was discharged or released therefrom under conditions other than dishonorable. See Maine Revised Statutes Title 20-A Sec. 20102
