As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings. [PL 1983, c. 736, §2 (NEW).]
1. Commerce. “Commerce” means trade, traffic, commerce or transportation within or through the jurisdiction of the State. “Commerce” does not mean movement of hazardous materials by a farmer for the farmer’s own use to and from the farm or field within a 20-mile radius.

Terms Used In Maine Revised Statutes Title 25 Sec. 2102-A

  • Commerce: means trade, traffic, commerce or transportation within or through the jurisdiction of the State. See Maine Revised Statutes Title 25 Sec. 2102-A
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Hazardous material: means a substance or material which has been determined by the United States Secretary of Transportation to be capable of posing an unreasonable risk to health, safety and property when transported in commerce, and which has been so designated in Title 49 of the Code of Federal Regulations, Part 172.   • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Person: means an individual, firm copartnership, corporation, company, association or joint-stock association, and includes any trustee, receiver, assignee or personal representative thereof. See Maine Revised Statutes Title 25 Sec. 2102-A
  • transportation: means any movement of hazardous material by any mode and any loading, unloading or storage incidental thereto. See Maine Revised Statutes Title 25 Sec. 2102-A
  • Trustee: A person or institution holding and administering property in trust.
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
2. Hazardous material. “Hazardous material” means a substance or material which has been determined by the United States Secretary of Transportation to be capable of posing an unreasonable risk to health, safety and property when transported in commerce, and which has been so designated in Title 49 of the Code of Federal Regulations, Part 172.
