1. Certain federal funds. Whenever a public works construction is built in whole or in part using federal funds and is under the jurisdiction of the federal Davis-Bacon Act or other federal act that requires the United States Secretary of Labor to establish the minimum wage and benefits and those minimum wages and benefits are established by the United States Secretary of Labor, sections 1304 to 1313 do not apply.

Terms Used In Maine Revised Statutes Title 26 Sec. 1314

  • Assisted project: means a construction project for which requests for bids or proposals are initiated on or after January 1, 2023, including requests for bids or proposals that supplement a process started on or before that date:

  • Construction: means any construction, reconstruction, demolition, improvement, enlargement, painting, decorating or repair of any public works let to contract. See Maine Revised Statutes Title 26 Sec. 1304
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Public works: includes public schools and all buildings, roads, highways, bridges, streets, alleys, sewers, ditches, sewage disposal plants, demolition, waterworks, airports and all other structures upon which construction is funded in whole or in part by state funds and for which the contract amounts to $50,000 or more.   • Registered apprenticeship: means an apprenticeship program registered with the Maine Apprenticeship Program in accordance with Title 26, chapter 37. See Maine Revised Statutes Title 1 Sec. 72
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • 2. Exceptions for registered apprenticeship programs. A contractor or subcontractor working on a public works project or assisted project subject to this chapter may hire a worker at the rate recognized for registered apprentices working in the pertinent classification only if the worker is a participant in a registered apprenticeship program. For purposes of this subsection, “registered apprenticeship program” means a program that is registered pursuant to 29 C.F.R. § 29.3 (2016) with the United States Department of Labor, Employment and Training Administration, Office of Apprenticeship or a state apprenticeship agency recognized by the Office of Apprenticeship.
