Terms Used In Maine Revised Statutes > Title 29-A > Chapter 13 > Subchapter 1 - General Provisions

  • Adjudication: means a finding by a court that a person has committed a traffic infraction and includes the acceptance by the clerk of the violations bureau or any judicial division of an answer of not contested. See Maine Revised Statutes Title 29-A Sec. 101
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Certificate: means the certificate of an insurance company or a surety company authorized to transact business in this State under Title 24-A that certifies that the company has issued a motor vehicle liability policy covering the vehicle involved in the accident.   • Conviction: A judgement of guilt against a criminal defendant.
  • Conviction: means conviction, adjudication or judgment, and includes but is not limited to a forfeiture of bail or collateral deposited to secure a defendant's appearance in court, on a charge of violating a motor vehicle law that has not been vacated. See Maine Revised Statutes Title 29-A Sec. 1551
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • highway: means a public way. See Maine Revised Statutes Title 29-A Sec. 101
  • Insurance identification card: means an identification of insurance in paper or electronic form issued to an insured by an insurer pursuant to Title 24-A, section 2412, subsection 7; or an identification of proof of financial responsibility in paper or electronic form issued by the Secretary of State to a person who elects to provide proof of financial responsibility in accordance with section 1605.   • Judgment: means a judgment that has become final without appeal by expiration of the time within which appeal might have been perfected, or by final affirmance on appeal, rendered by a court of competent jurisdiction of any state or of the United States. See Maine Revised Statutes Title 29-A Sec. 1551
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Mobile telephone: means a device used to access a wireless telephone service. See Maine Revised Statutes Title 29-A Sec. 101
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Motor vehicle liability bond: means a bond certified as proof of financial responsibility in accordance with section 1605. See Maine Revised Statutes Title 29-A Sec. 1551
  • Motor vehicle liability policy: means a policy of liability insurance certified as proof of financial responsibility in accordance with section 1605, and includes, but is not limited to, a motor vehicle liability bond. See Maine Revised Statutes Title 29-A Sec. 1551
  • OUI: means operating under the influence of intoxicants or with an excessive alcohol level. See Maine Revised Statutes Title 29-A Sec. 1551
  • Owner: means a person who holds:

  • Person: means every person, firm, copartnership, association or corporation, but not the State or any political subdivision of the State. See Maine Revised Statutes Title 29-A Sec. 1551
  • Policy: means a motor vehicle liability insurance policy or motor vehicle liability bond. See Maine Revised Statutes Title 29-A Sec. 1551
  • Portable electronic device: means an electronic device that is portable in nature, including but not limited to a device for sending or receiving e-mail, a text messaging device, a mobile telephone and a computer. See Maine Revised Statutes Title 29-A Sec. 1551
  • Secretary of State: means the Secretary of State or the Secretary of State's deputy. See Maine Revised Statutes Title 29-A Sec. 1551
  • State: means a state of the United States, the District of Columbia or a province of the Dominion of Canada. See Maine Revised Statutes Title 29-A Sec. 1551
  • Text messaging: means reading or manually composing electronic communications, including text messages, instant messages and electronic mail, using a handheld electronic device. See Maine Revised Statutes Title 29-A Sec. 101
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
