  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Expedited license: means a full and unrestricted medical license granted by a member state to an eligible physician through the process set forth in the compact. See Maine Revised Statutes Title 32 Sec. 18503
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.

  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.

  • Municipal fire department: means an organized firefighting unit established under municipal charter, ordinance or bylaw to prevent and extinguish fires and, if authorized by charter, ordinance or bylaw, to provide emergency services. See Maine Revised Statutes Title 30-A Sec. 3151

  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Practice of medicine: means the clinical prevention, diagnosis or treatment of a human disease, injury or condition requiring a physician to obtain and maintain a license in compliance with the medical practice act of a member state. See Maine Revised Statutes Title 32 Sec. 18503
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provide emergency services: means to respond to and manage other public safety emergencies, including, but not limited to, medical emergencies, hazardous materials incidents or natural or man-made disasters. See Maine Revised Statutes Title 30-A Sec. 3151
  • registered mail: when used in connection with any requirement for notice by mail shall mean either registered mail or certified mail. See Maine Revised Statutes Title 1 Sec. 72
  • Rule: means a written statement by the interstate commission promulgated pursuant to section 18513 that is of general applicability; implements, interprets or prescribes a policy or provision of the compact or an organizational, procedural or practice requirement of the interstate commission; has the force and effect of statutory law in a member state; and includes the amendment, repeal or suspension of an existing rule.   • State: means any state, commonwealth, district or territory of the United States. See Maine Revised Statutes Title 32 Sec. 18503
  • State of principal license: means a member state where a physician holds a license to practice medicine and that has been designated as the state of principal license by the physician for purposes of registration and participation in the compact. See Maine Revised Statutes Title 32 Sec. 18503
  • Subpoena: A command to a witness to appear and give testimony.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Unlawful: means not expressly authorized by statute. See Maine Revised Statutes Title 17-A Sec. 952
  • Verdict: The decision of a petit jury or a judge.
  • Volunteer fire association: means an organized firefighting unit incorporated under Title 13, chapter 81, or Title 13?B, and which is officially recognized by the municipality. See Maine Revised Statutes Title 30-A Sec. 3151
  • Volunteer firefighter: means an active member of a volunteer fire association who receives no compensation from the municipality other than injury and death benefits. See Maine Revised Statutes Title 30-A Sec. 3151
  • Volunteer municipal firefighter: means a part?time or on-call municipal firefighter who receives up to 20% of the compensation of a full?time municipal firefighter and who may receive injury and death benefits. See Maine Revised Statutes Title 30-A Sec. 3151
