1. Violation. A person, firm or corporation may not violate this subchapter or a rule adopted pursuant to this subchapter.

Terms Used In Maine Revised Statutes Title 7 Sec. 769
- Commissioner: means the Commissioner of Agriculture, Conservation and Forestry. See Maine Revised Statutes Title 7 Sec. 762
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72
- Person: means individual, partnership, association, firm or corporation. See Maine Revised Statutes Title 7 Sec. 762
2. Penalty. The following penalties apply to violations of this section.
A. A person who violates subsection 1 commits a civil violation for which a fine of not more than $100 may be adjudged. [PL 2003, c. 452, Pt. B, §12 (NEW); PL 2003, c. 452, Pt. X, §2 (AFF).]
B. A person who violates subsection 1 after having previously violated subsection 1 commits a civil violation for which a fine of not more than $200 may be adjudged. [PL 2003, c. 452, Pt. B, §12 (NEW); PL 2003, c. 452, Pt. X, §2 (AFF).]

3. Application. This subchapter may not be construed as requiring the commissioner or the commissioner’s agent to bring suit or institute seizure proceedings as a result of minor violations of this subchapter when the commissioner believes that the public interest will be best served by a suitable notice of warning in writing.
