  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • state: means :

    (1) a state, possession, territory, or commonwealth of the United States; or

    (2) the District of Columbia. See
Any action or other remedy enforcing this title is subject to any immunity or limitation on liability available under State or federal law or at common law.
