Section 16. (a) Each state-operated veterans’ home shall apply for and maintain certification by the federal Centers for Medicare and Medicaid Services to participate in the Medicare and Medicaid programs, pursuant to subpart B of 42 CFR 483. The superintendent of each state-operated veterans’ home in coordination with the executive director of veterans’ homes and housing shall ensure that compliance with the requirements of said subpart B of 42 C.F.R. § part 483 shall be maintained and that all compliance failures are addressed in a timely manner. The superintendent, in coordination with the executive director, shall submit to the governor, the secretary of veterans’ services, the secretary of health and human services and the veterans’ homes council, established pursuant to section 41 of chapter 6, a report of any compliance failures identified during the annual survey conducted by the division of health care facility licensure and certification not later than 30 days after the compliance failure is identified. The report shall outline each compliance failure and a plan for corrective action.

(b) The superintendent of each state-operated veterans’ home, in coordination with the executive director of veterans’ homes and housing, shall ensure that the home adheres to guidelines for trauma-informed care as outlined by the United States Centers for Disease Control and Prevention.
