  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories.    Such drawing shall be conducted at the place of the holding of said court at the time so fixed by the judge, or at such adjourned time as he may order. Such drawing shall be conducted by the clerk in the presence of the judge, shall be public, and the defendant and his attorney, and the prosecuting attorney in state cases, and the city attorney in city cases, shall be entitled to be present.
