  • Accredited laboratory: means a DNA laboratory that has received formal recognition that it meets or exceeds a list of standards, including the FBI director's quality assurance standards, to perform specific tests, established by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic community in accordance with the provisions of the federal DNA identification act, 42 USC 14132, or subsequent laws. See Michigan Laws 752.932
  • Adult entertainment establishment: means either of the following:
  (i) An adult entertainment establishment that holds a topless activity permit under section 916(3) of the Michigan liquor control code of 1998, 1998 PA 58, MCL 436. See Michigan Laws 752.1032
  • Analyzed: means evaluating items for the presence of a body fluid, cellular material, or DNA followed by the testing of suitable items at forensic DNA regions for comparison purposes. See Michigan Laws 752.932
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Board: means the human trafficking health advisory board created in section 3. See Michigan Laws 752.992
  • Chambers: A judge's office.
  • Claim: means any attempt to cause a health care corporation or health care insurer to make the payment of a health care benefit. See Michigan Laws 752.1002
  • Commission: means the sexual assault evidence kit tracking and reporting commission created in section 2. See Michigan Laws 752.961
  • Commission: means the human trafficking commission established in section 3. See Michigan Laws 752.972
  • Commission: means the Michigan commission on death and dying created in section 3. See Michigan Laws 752.1022
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Decedent: means a deceased person and includes, but is not limited to, a testator, grantor, bargainor, vendor, donor, or person who dies intestate. See Michigan Laws 205.256
  • Decedent: A deceased person.
  • Deceptive: means making a claim to a health care corporation or health care insurer which contains a statement of fact or which fails to reveal a material fact, which statement or failure leads the health care corporation or health care insurer to believe the represented or suggested state of affair to be other than it actually is. See Michigan Laws 752.1002
  • Department: means the bureau of revenue of the department of treasury. See Michigan Laws 205.256
  • Department: means the department of state police. See Michigan Laws 752.912
  • Department: means the department of state police, including its forensic science division. See Michigan Laws 752.932
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 752.1032
  • Devise: To gift property by will.
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • False: means wholly or partially untrue or deceptive. See Michigan Laws 752.1002

  • Fund: means the student safety fund created in section 7. See Michigan Laws 752.912
  • Gross estate: means the gross estate determined under the internal revenue code. See Michigan Laws 205.256
  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Health care benefit: means the right under a contract or a certificate or policy of insurance to have a payment made by a health care corporation or health care insurer for a specified health care service. See Michigan Laws 752.1002
  • Health care corporation: means a nonprofit dental care corporation incorporated under Act No. See Michigan Laws 752.1002
  • Health care facility: includes a hospital, clinic, or urgent care center that is regulated under the public health code, 1978 PA 368, MCL 333. See Michigan Laws 752.932
  • Health care insurer: means any insurance company authorized to provide health insurance in this state or any legal entity which is self-insured and providing health care benefits to its employees. See Michigan Laws 752.1002
  • Health facility or agency: means a health facility or agency, as defined in section 20106 of the public health code, Act No. See Michigan Laws 752.1002
  • Hotline: means a statewide toll-free telephone number or other means of communication, or a combination of a toll-free telephone number and another means of communication, that transmits voice, text, photographic, and other messages and information to the department through the departmental website described in section 3(2).   • Human trafficking: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 752.972

  • Investigating law enforcement agency: means the local, county, or state law enforcement agency with the primary responsibility for investigating an alleged sexual assault offense case and includes the employees of that agency. See Michigan Laws 752.952
  • knowingly: means that a person is in possession of facts under which he or she is aware or should be aware of the nature of his or her conduct and that his or her conduct is substantially certain to cause the payment of a health care benefit. See Michigan Laws 752.1002
  • Law enforcement agency: means the local, county, or state law enforcement agency with the primary responsibility for investigating an alleged sexual assault offense case and includes the employees of that agency. See Michigan Laws 752.932

  • Legislative council: means the legislative council established under section 15 of article IV of the state constitution of 1963. See Michigan Laws 752.1022

  • month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Nonresident: means an individual who is not a resident. See Michigan Laws 205.256
  • Owner: means a person who owns the sounds fixed in a master recording on which sound is recorded and from which the transferred sounds are directly or indirectly derived, or the person who owns the rights to record or authorize the recording of a live performance. See Michigan Laws 752.1051
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patient: means a person who engages in an act of voluntary self-termination. See Michigan Laws 752.1022
  • Person: means an individual, firm, partnership, joint venture, association, corporation, limited liability company, company, estate, or any other group or combination acting as a unit. See Michigan Laws 205.256

  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire.   • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • property: means the property or interest in property of the testator, intestate, grantor, bargainor, or vendor, passing or transferred to those not specifically exempted from this act, and not as the property or interest in property passing or transferred to the individual legatees, devisees, heirs, next of kin, grantees, donees, or vendees, and includes all property or interest in property whether situated within or without this state and including all property represented or evidenced by note, certificate, stock, land, contract, mortgage or other kind or character of evidence thereof, and regardless of whether that evidence of property is owned, kept or possessed within or without this state.   • Recording: means the tangible medium upon which sounds or images are recorded or otherwise stored. See Michigan Laws 752.1051
  • Resident: means that term as defined in section 18 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 205.256
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.

  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Transfer: includes the passing of property or an interest in property in possession or enjoyment, present or future, by inheritance, descent, devise, bequest, grant, deed, bargain, sale, or gift in the manner prescribed in this act. See Michigan Laws 205.221
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Victim: means , for the purposes of making communications and receiving notices under this act, an individual who was subjected to a sexual assault offense. See Michigan Laws 752.932
