69-14-111. Supervision of railroads. (1) The commission shall supervise railroads subject to the provisions of this chapter.
Terms Used In Montana Code 69-14-111
- commission: means the public service commission provided for in 2-15-2602. See Montana Code 69-1-101
- railroad: means a corporation, company, or individual owning or operating a railroad in whole or in part in this state. See Montana Code 69-14-102
(2)The commission may:
(a)adopt or enforce regulations and orders related to railroad safety or security in accordance with 49 U.S.C. § 20106;
(b)bring civil action in a district court for violations of federal railroad safety regulations in accordance with 49 U.S.C. § 20113; and
(c)participate in investigative and surveillance activities in accordance with 49 U.S.C. § 20105.
